Hello All, with the BR court date set for 5th january and a move in to rented accomadation on the 2nd january I really now have to tackle my BR forms and in particular the SOA. A couple of questions if i may;
With regard to my statement of affairs, is that my current SOA with mortgage, secured loans etc, all whilst still living in my mortgaged house or should the statement of affairs be relevant to once i have moved into my rented accomadation on the 2nd of january?
Obviously once i have started to rent and up until bankruptsy i will still be liable for my mortgage, loans etc aswell as my new rent payments?
How do i show all of this on my SOA and the Bankruptsy forms?
As my move in date is so close to my bankruptsy date it may be difficult to be accurate with new outgoing in the new house, what do you guys think?
I really do not want to sell my self short or be inaccurate.
Hope you guys can help, Thanks.

Hi SSC - first of all if you are going BR o 5th January STOP paying all your bills now!!!!!! What are you planning on doing with your house? You shouldn't pay any more towards your mortgage if you aren't keeping your house. Any money you pay towards any of your current bills (except council tax) is a big waste of money that you should be saving to see you through the next few months of bankruptcy. Remember you will have no cushion (or credit!) to fall back on after 5th January.
Do you have your BR fees?
As for the SOA, since you are moving on 2nd January fill in the forms with new rent, I would tend to put what you currently pay for gas, elec, water, council tax, phone etc and when you have your OR interview you can say thats how you calculated things (you can then alter anything if it changes significantly).

Thanks FYFplan, I have stopped paying all of my creditors for two months now and come the 1st january that will be three missed payments to all creditors which include the mortgage, secured loan , cc etc. I have paid all utilities and council tax to date as I would expect to transfer once i have moved into rented accomadation. Is this right? I do need to contact the council though to ask for an exemption once i have moved out.
With regard to the house i am entering into volo repo, but i do not know if its best to do that before or after bankruptsy?0 -
Glad to hear you've stopped paying creditors but are up to date on priority bills. If you are moving within the same area you could transfer those utilities. Yes if you move out before BR you will need to notify the council that you are not living in mortgaged property so you won't be liable for council tax. Regarding when to give up the house I don't think it matters if you do it before or after BR. They may tell you that you'll be liable for shortfall and will want you to sign something to that affect - don't sign anything let your OR deal with it.
