does telling your creditors your going br look good to the OR

my brother went br last year(obviously in the blood) i spoke to him last night he asked how i was getting on and said have i told the creditors im going br i said no and hes advised i should as it looks good for me

so does it?

do you get asked if youve told them or not?

and does it go in your favour?

i was just going to wait for the OR to do it or let them find out, as ive booked the date but just incase i cant raise the funds and have to postpone it i didnt want to give them all the details and i have to change the date

    I never used to ask people if they have informed creditors, as far as I know it has no bearing on your case.

    I just told mine i was seeking help. Don't think there are any benefits in telling them beforehand,if anything, it may make them more persistent.Dx

  • I certainly didn't tell my creditors I was going BR, all that will do is encourage them to increase the pressure on you!

    Also they can apply for a CCJ and then have it secured against your home!

    I would advise against telling them.

    Have you spoke to one of the debt charities listed in the sticky at the top of this forum?

  • yeah i spoke to the CCCS and the CAB the CAB lady said if i want her to she will send them all a letter stating im going br. i said i would rather she didnt incase they did step the hassling up a gear, she said i dont think it makes them hassle you more but i told them before i was unable to pay and was seeking help but they still demanded money from me and said their threats.

    so i havent bothered as i had 1 DCA demand i pay the full balance which was nearly 3k asap the only payment plan they would accept was £100 amonth for 3months then the full balance. this was what made me seek help as i panick and was contemplating asking family members and getting high intrest loans till i spoke to the CCCS and he advised me on what powers they did have as i didnt know they was just threats.

    sorry drifted slightly off topic there but basicly they dont listen when i said i had no money so why would they care if i say im going br

  • I really would just ignore them untill you have declared yourself BR. There is nothing they can do about it, so let them waste there time!

  • none of the letters have been the serious ones well apert from the one that i just wrote about as they said blah blah sending your case to a solicitor, and a week later on decent looking proffesional paper is the words solicitors i rang that number and it turned out to be the DCA(sneaky) thats what made me contact CCCS, thatdebt has now passed to another DCA so their sneaky scare tactics nearly worked as when i recieved the solicitors letter i broke down in tears rang my mum and confessed about the mess i was in and wonderd how i could get the money in a week luckly i rang her first as i was thinking of them lovely debtloan people that charge 500% interest

  • I told some creditors that I was looking in to Br and one said "Do you know how much it costs to go Br" Only one held off the dogs but the rest still hounded!!!


    I informed a few of my creditors that I had a Bankruptcy Order so they would stop ringing me before they heard from the OR. It has all gone quiet!!!
