Going bankrupt in Scotland

Hi,

Does anyone know what the chances of a creditor making me and my husband bankrupt are? We live in Scotland and have been told by the CCCS that we either have to wait for a court order or try and get someone to agree to making us bankrupt. I've written them all a letter tonight asking them to do so but not sure what our chances are. We've missed two months worth of payments so far but not sure if this is enough. Anyone know? :eek:

    I've been thinking about this, but having difficulty in coming up with any brilliant ideas.

    I hope that writing to your creditors will get some results for you. Please let us know what happens. If one of your creditors agrees to make you bankrupt, or to 'concur' with you making yourself bankrupt, then we can help you with the next steps.

    Hi, I think unfortunately with only two months payments missed, your creditors are likely to try all sorts of tricks to try get their money back before making you bankrupt. Are you actually insolvent at all? with your debt repayments, are your outgoings more than your income? And have you got a property? And does it have negative equity? Lots of questions, sorry. but more info will help us try help you. Though Scottish BR is a bit different from the English side of things am afraid. :D

    Our outgoings are way above our income due a variety of personal disasters this year. We now only have my income which just covers our living expenses. We've handed the keys back to the lender on our property and I'm positive we will end up in negative equity when they sell it. Thank you for all your help.
