Hi all,
After my telephone interview with a lovely girl here in NI through CCCS I was advised to:
I am up and down emotionally but quite honestly if you look at my earlier posts I don't think I have any other choice.
I'm too old for a DMP as I will be nearly 60 and I hate the house I have as it's in such a bad area. So I will ponder on my decision and as usual look for feedback from yourselves..



After my telephone interview with a lovely girl here in NI through CCCS I was advised to:
- Open a Co-Op cashminder account
- Find somewhere to rent
- Inform Northern Rock of voluntary surrender
- Pay everything up to the middle of December and then transfer DD's to the Co-Op account plus my salary.
- Organise moving into rented accommodation Jan 09
- Send on headed paper a letter from CCCS saying I was in financial trouble and please would the companies accept a token payment including my bank of 11 years where I have an overdraft.
- Wait on Northern Rock auctioning the house
- Once Northern Rock come back to me with the shortfall declare myself BR and hand in my forms/ fees

Hi Jan, I don't think that you have to wait on NR coming back to you with the shortfall, it will get automatically included anyway. But i could be wrong so I am sure there will be someone along to check this for you. It could take many months before NR auction the house.BSC #215/No.1 Jan 09 Club0

Thanks for getting back to me. Do you mean with your reply that as soon as I move out and into rented accommodation I should declare BR? I was also advised to rent the house in my partners name. He has his own council house at £230 per month so it should still be OK for him to put his name on mine. How does the OR view this though with the house being in his name. Don't get me wrong he will stay but he has his kids 3 nights a week so he needs his own space.0 -

I too am going through the CCCS. Have you spoken to their dedicated bankruptcy line? I can get you their number if not. I found it much better speaking to them than the normal CCCS no, although don't get me wrong I cannot fault them one bit. We are going into rented accommodation as soon as we have enough money for deposit + BR fees and find somewhere. We are going bankrupt as soon as we are ready to and have been advised the repossession will form part of the bankruptcy anyway.
Sorry can't help you re having the house in your partners name as I am new to all this too.

Hi completeness,
Here in Northern Ireland there seems to be only CAB or CCCS - NI debtline with a call centre and offices provincewide. I don't know the girl Samanatha said I couldn't walk away until NR took possession of the house ie voluntary surrender but the whole thing baffles me.

Hi like completemess says, get the advice of the cccs dedicated bankruptcy line because they are more specialist. and I can only agree with what cm said about the repossession forming part of the bankruptcy. but I am certain there have been others on here who had their house repo after BR and the shortfall was included and they had moved into rented by this time.
As far as I am aware, the OR doesn't really take an interest in whose name is on the rental agreement either. so it should be fine for your OH to rent in his name.
You can do voluntary repossession and send the keys back and move out. If you wait on NR doing the formal repo, it could take many months by the time they sell the house on, and if you wait all that time until the house is sold, you will be so stressed and it is not worth it.
Please do get advice from the cccs bankruptcy section.

Hi Jan,
You really don't need to wait until NR has repossessed, this can take up to a year. :eek: As soon as you have moved out you can go BR. The shortfall will always be included, no matter how long after BR it is.

She said I couldn't work out my debts without NR imput on my SOA because she didn't know how much the house would sell for. She said I should keep making token payments of £5.00 to my 3 credit cards and my bank until I was declared BR.
I am so confused as to what to do think...or do0 -

as the pp have said it will all be included in your br no matter how long it takes for the house to sell so you can move out now if you can afford to.
also you dont even need to pay token payments if you dont want to as basicly any money you give them could be saved for the br fees as if youve deffinatly decided to go br then the token payments are just to stop them ringing you constintly basicly, but from my experience i started giving them token payments and they still rang me everyday in case i suddenly found millions of pounds under my bed and could afford to pay them more. so its completely up to you.
i havent payed the cc in months, at first i done token payments but now ive decided br i dont bother as its all going to be wiped off in br anyway so im just saving it for the fees now. and the only dca im getting hassled with ringing everyday is over my overdraft which is far less money than the ccIf you want to see the rainbow ,you gotta put up with some rain0
