HSBC Deluging Wife With Letters!

My wife has got herself into financial difficulty and has, sensibly, put the matter in the hands of CCCS. She is paying them a large lump of her salary each month in order to clear her debts. It seems to be working well, except:

HSBC is the one creditor who insists on badgering her with constant 'phone calls and letters. Many of the letters contain veiled threats and each letter comes from different person and location. Some of the letters are downright nasty, telling her that if she does not pay off the outstanding balance "immediately" they will "start procedures to recover the money".

Sometimes they craftily slip in a document for her to sign which CCCS have warned her NOt to sign as it is in effect a new credit agreement for the money outstanding!

She has written to HSBC on numerous occasions explaining to them that her matters are being dealt with by CCCS and threatening them with action for harassment, but still the letters flood in!

What can she do?

    Hi and well done for posting......I understand about being harassed by creditors and I am positive someone on here will have some great advice for you. I am fairly new on here, but have received some wonderful support and help. There are a loads of people on this site who have great knowledge of how to deal with creditors, and I feel before long someone will read your post and get back to you.

    HSBC should be OK regarding documentation, but the fact that they are sending her new credit agreements sets off alarm bells.

    Have you ever requested the credit agreement for the original account?
    And has she sent them a letter demanding tha they reove her phone numbers from their records?

    Then she can report them to the Information Commisioner under the DPA if they carry on.

  • Would be interested to hear the responses to this. Our DMP starts in December and HSBC are the one creditor that seem to be quite nasty. They sent my husband a very threatening letter and when we phoned them, they said they could see how much money we have spare and so we can afford to pay them more. The truth is - the money they see as "spare" is what we pay CCCS and what they in turn pay all of our creditors. We tried to explain this to them but they don't seem to be very understanding. I have written a letter in response and my husband signed it, but I think they will ignore it, so would like to hear other people's responses!!

    We started our DMP March 2008, and like yourselves we had several creditors who constantly rang or wrote....they were ringing my hubby at work, and no matter how many times we told them not to ring, they still did. We told our DMP case officer and were told, not to speak to them, just to refer them back to Payplan, as they were dealing with it.... That was fine for a while, but certain creditors have started th hassle again, although we have paid continuously sine March......Hopefully they will go quiet again for a while..... Good luck with you DMP, its a long road, but one definitely worth taking.:T:T

    She has never requested a new credit agreement and she has written to them stating that her finances are being dealt with by CCCS but still the letters arrive weekly or more often!
  • It constantly beggars belief that banks behave in this manner, when you are adopting a perfectly legal route to sort out your debts!Not only that but you also follow their own advice written in clear terms on their website.

    As it seems to be on every bank's website..I would be sorely tempted to photocopy and send it back along with a strongly worded letter about harrassment etc.when you are cooperating and working within the bank's guidelines.
