Hi, i've new on here, so apologies if this is a common question asked, i briefly searched but cant find anything.
Basically, i bought a pair of GHD's from ebay in February 2008, paid just under £100 for them, paid via paypal with a credit card. Have today had an email from a solicitors telling me they think my purchase was counterfeit and to contact them with the serial number - so i did, confirmed they are counterfeit! I contacted paypal and was basically told it cant be disputed because its longer than 45 days ago .........
Is there anything i can do to claim back from paypal or my credit card for the amount, after such a long time has elapsed?
Thanks in advance for any responses

Can you remember who you bought them off?
I guess you could ask them for a refund (explain to them why), and if they refuse, then threaten them with a claim through the small claims court.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
Did the solicitor explain why they are contacting you ? Perhaps they are taking some form of class action against the seller, in which case they may be and option for some recovery.
I'm not sure what the time limit is for claiming under your card - the normal limitation for a legal claim is 6 years, but CCA regulation may be different- best to give your credit card company a call.
See http://www.bbc.co.uk/consumer/guides_to/credit_liability.shtml for further advice.0 -
If you were happy with your purchase before the letter why are you worried o/k they were fakes but obviously good ones as you did not notice so forget about it life is too short.0

Given that fakes won't have the same electrical checks as genuine GHDs, then there's a risk of fire or electric shock. These could have been made anywhere, like in some dodgy China backstreet factory!!
Or perhaps they're genuine, and a fake pair were registered under the same serial code first?Should've = Should HAVE (not 'of')

Unfortunatly even the genuine article is probably made in some dodgy backstreet factory!! Some of these places make both genuine (paid by contractor) products and fake (workers on the side).0 -
i agree with lowbrim, if ur happy with the purchase why worry0

Also be aware that even though the serial number may not be in GHD's UK database they will be classed as fake even if they are not. They could have come direct from the factory and not via a GHD agent such as the ones sold by some of the big retailers such as tescos. They werent fakes but anyone who tried to register them via the ghd website was told they were. You may have one of those.=======================

Thank you all for your replies.
Yes, i am aware of the email address of the personal that sold them to me, and have tried to contact him but to no avail (cant actually say i expected a response!). As already said paypal dont want to know now, and have thought about going through the credit card company, but was slightly concerned as i bought them for £99.10 and thought the limit for claiming anything had to be over £100 (not certain of that so will try that route if needed).
If i'd paid £50 for them i would have thought they may be not genuine and wouldnt have got what i bought, but i paid practically the same money as if i would buy them from a shop (give or take a tenner). I have also contacted Ebay and they havent replied either.
Its like buying a Gucci bag in a shop in Turkey for £30, you pay £30 and know your buying a fake Gucci bag so are happy to pay that sort of money for it, but i thought i was buying a genuine article - how stupid was I!
To answer the question, why if there is nothing wrong with them why worry, i'm worried because the solicitor that contacted me has advised me not to use them again!!! Due to heath and safety reasons, i actually bought them for my 14 year old daughter, so do i want to risk her causing injury to herself, obviously not! So i've effectively thrown £100 in the bin.
I have today, emailed back the solicitor who contacted me to inform me that the goods were actually counterfeit and asked their advise, so am currently awaiting their response to see if there is anything i can do!

I don't have any sensible suggestions but you can find lots of info on similar fakes here

This one is a bit worrying:

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
I cant believe people think because the supposed fake GHDs are OK now that its fine to carry on using them! The unit price for these fakes can be around $20-$30 from a Chinese dropshipper. The OP has every right to be annoyed at the seller who sold them, if the seller imported in bulk they would have made a tidy profit. Besides genuine GHDs aren't made in China.
Is it worth ringing Trading Standards about it?0
