Working Tax Credits

Can anyone answer this question, my husband bought with his father a business in the US last October, due to the economic climate it has not done very well, (he has a 0% profit certificate as proof of earnings ) he comes back home when he can. and i have a seasonal business here and he came back to help me with that , i summited a total earnings for myself and his earnings while he was in the Uk and have received a form from WTC regarding his residential address , does he have to reside here for 52 weeks of the year to get WTC , and if he does , would i be elgible as i work over 30 hours a week ? I am asking this as they have just awarded me a payment as my earnings are so low, and afraid they are now going to ask for it back, even though I receive no income from him .

    TCO need his residency details so that they can decide if you should have a single claim in your own name or a joint claim with him. You need to supply as much detail as possible to them about how often he comes back to the UK and for how long.

    Your claim would be dealt with by the Complex case team as your circumstances are complicated
