Think I've made a mistake...

Think I've made a mistake in taking out an IVA through CCCSVA....IVA was accepted on 8th September.....still have one creditor [ Moorcroft ] pestering me...to the extent that they sent a doorstep collector out today...who I showed details of IVA to....this is despite saying this week that account would be put on hold for 2 more weeks.
I have sent the correspondance I recieve to CCCSVA and have repeatedly asked them to get in touch with Moorcrot....when I rang CCCSVA again this week they said.they hadn't had time to deal with it yet....I appreciate they are dealing with thousands of people...but I was told 6 weeks ago that they were getting in touch with Moorcroft.
I'm seriously beginning to think an IVA was not the right decision...especially considering other aspects [ I am in remission from breast cancer so consequenly at anytime I may not e able to work or have to reduce my hours ]....I have no assets, house is housing association........am thinking bankruptcy would of been the right thing to do.
But how the hell am I going to be able to do that now??

I'm surprised at CCCS recommending an IVA in your case as you have no property to protect. Seems like dodgy advice from CCCS.
It seems to me that Moorcroft are ignoring the IVA - creditors should have no contact with you whilst you are in an IVA. Maybe worth sending a letter to their complaints department and to Trading Standards.
Speak to CCCS re bankruptcy. Not sure about it all but as you are fairly new into the IVA they may be able to stop it.
Not sure what else to say I'm afraid.

I was surprised they recommended IVA....there reason if I remember rightly was as their was a surplus of £196 a month which could be paid through IVA.
The one reason I was dubious about it was because obviouslyits a 5yr commitment...and although I know on-one knows what will happen in those 5 years...I have more reason than most to worry due to health issues....I did ask that if I was to die in that 5 year period what would happen and they said the IVA would be wiped and no-one else would be liable for it.0 -
I would still give CCCS a ring on Monday and discuss your options with them.
Sorry to hear of your health issues. Hope everything is ok for you. Don't let the debts get you down. Your health is far more important and you don't want to get any worse.

Wil ring CCCSVA... have emailed them too...explaining situation with Moorcroft and how I am concerned that this happened especially as I have been asking them for weeks to contact them..I also stated that maybe an IVA was not the best course of action and maybe I was ill advised.0

Selling an IVA to you with no assets or job to protect and knowing your income was not stable now let alone for five years due to health was wrong
the surplus is not relavent unleess you could guarentee it for the five years of the IVE, if you indicated it was likely it would not be so they should not have signed you up to an IVA

Maybe this should also be mentioned on the IVA board as a warning or at least things to consider before signing up. I'm sure people sign IVA's just because thats what they've been advised and they're scared of BR when down the road they end up BR anyway.

fiveyearplan.......yes it would be a good idea to mention this on IVA board too.
I took the IVA option as I was advised that was the best route for me...even though I explained about my health, and the fact that £300 of monthly income was from non-dependent still living at home.
I know I am going to end up down the BR route.....just wish I hadn't panicked because creditors were constantly on my case ..even though I was in a DMP originally.....and thought IVA sounded like the best option as it would stop creditors harrassing me and I would be making at least some contribution to my debts.....hind-sight is a wonderful thing!0 -

I'm on a dmp with CCCS at the moment, having originally considered an IVA before I knew anything about them. I was advised also that an IVA was the best route for me - when it wasn't...but that's the sharks for you!!!
