om signed for double glazing but the house is not hers

Breakdown of facts
My parents live with me in my house (my name on mortgage/bills etc which I pay)
Anyhow for some unfathombly reason
on Wednesday my Mom (79) decided to take a cold call door to door double glazing canvesser to her heart :mad: and book an appointment for a salesmans to call today Thursday....tp give her a quote. She never mentioned any of this to me I was at work......today the salesman called and she agreed to a window design she hates (neighbour has them and she hates them) but saleman told her they were the best........*rubbish* for a 4ftx4ft window he told her it would cost £1015..... with her discount for signing today it would cost £780....God help me she agreed..........:eek: and signed a contract and paid a £40 deposit....now the salesman wrote the cheque out for her of £40 deposit as she cannot do that due to arthritis and other ailments to numerous to mention.
anyhow as she invited the chap to call for an appointment can I cancel tomorrow...........have I any right to cancel....On the reverse it says "rights etc"
If you contact a saleman and invite them to call you have no cooling off period...My arguement is she did not contact them they cold called........ plus............:wall:
1. Its not her house
2. We don't need the window
3. She hates that type of window as do I
4. She does not have the money....
5. I am going crazy here

First thing to do is contact the double glazing company and explain.
If that does not get it sorted then if you have legal protection with any kind of insurance give them a call.
You may lose the £40 deposit but if you contact them now they won't have had time actually spending money to make the windows.0 -
They cant force you to pay or have it fitted but they can certainly sue your mother for damages and the very least she will likely lose is the deposit.
The only out would be if she was mentally incompetent and this was clear to the salesman
You could always try the negative PR argument though0 -
I think you can cancel if they cold calls within 7 days
They are also meant to be changing this for non cold callers

Call them and tell them the saleman has taken advantage of a 79 year old woman. You can get the original cheque back from the bank with the salesman's hand-writing.
Threaten them with trading standards, watchdog, the works.
Then see if there's vacancy at the local retirement home.

Both Antispam and Daytona_nev have it right.
There is new legislation that means firms have to act fairly when selling things like that. So the OP should complain to trading standards anyway. It's easy to do you just go online - http://www.tradingstandards.gov.uk/ - put in your postcode and send an email complaint.I'm not cynical I'm realistic

Thank you I have complained to trading standards and they were brilliant I am in Birmingham and they have already in place "no cold caller areas" and it appears I do have 7 days as it was an unsolicited orginal call.....ie cold call which I thought I did but was unsure as she made an appointment for the rep to call with the canvesser however....that itself was cold calling - I was so annoyed yesterday not thinking straight.
I have phoned the company and made it clear I am cancelling the order they were okay but did not put up any defence. Sent a letter to them R/Del so should be the end of it now.
I have also cancelled the cheque also which "NAT WEST" when my Mom expalined overrode standing charge of a £10 charge to cancel a cheque (very good of them I think excellent customer service)

This reminds me of a story my friend told me. My friend was a regional sales manager for a well known national double glazing company. One of his sales team got a £10k order for new windows on a large house.
The windows were later installed and the occupier was asked for the balance to which he replied: "Ask my landlord for the money!"
The landlord refused to pay for the windows on the basis that he never ordered them and the old wooden windows were perfectly sound and serviceable. The tenant was on benefit and was living in the property through a social housing/private landlord rent scheme. So in the end the tenant and landlord got new windows and the double glazing company had to take the hit. For this reason a lot of DG companies are dubious about work in areas full of social housing.The man without a signature.0
