Amazon Market Place and refunds?

Hi there i'd like to know if many people have had experience with dealing with amazon marketplace and bad sellers?
Basically this is my story.
Early last week i ordered a laptop from a marketplace seller, the order has been processed and the money taken from my account. With a dispatch estimate of the 10th. This dispatch hadn't occurred by the end of Monday (10th) and so i emailed the seller through Amazon. I've had no response since then. I've also rung the number on the the sellers storefront which goes straight to answerphone. I've left a message - same result no contact.
This morning i logged into my account and checked and still no dispatch, and when checking the sellers storefront i now get "Important Message
The XXXXXXXXXXXX Storefront is temporarily unavailable from the Seller. Please try again at a later time or search for the product on Amazon using the search above."
Definitely feels like something fishy is going on here...
I've just spoken to amazon who have told me that they have no indication that the item has been dispatched and that it should have been since its listed as instock by the seller. They wouldn't comment ont he fact the storefront has disappeared.
They've basically told me that i have to wait until the 26th (last possible delivery day) then try to contact the seller and that if i can't get in contact within 3 days i should contact them for a refund.
It seems like a long time to wait but oh well.
Considering the fact that the item hasn't definitely not been sent against the "sellers should send out within 2 days" rule do i have any course of action on this? I'm 98% sure this item isn't going to turn up (esp since the storefront appears to have been closed) Has anyone ever played hardball with amazon about getting a refund since the item wasn't dispatched on time?

i was about to buy some earphones, Amazon themselves sold them for £50 ish but they had marketplace sellers offering them for £18 !!
After a bit of digging i found that many of the earphones of that make were fakes, leaving me to assume Amazon allows these traders to do what they like:mad:living on the "edge"0 -
On the 2 occasions I have had to go through Amazon for a refund it took ages. Amazon are not interested until the last possible moment, a lot of sellers just ignore requests for refunds until made to.
I would be very concerned the shopfront has disappeared....0 -
Unfortunately in terms of monitoring a sellers performance, when a buyer logs an A to Z claim that then acts as a black mark, whether or not the seller then responds so there is no incentive for them to action the claim quickly, or indeed at all. Bit of a flawed system really.0

Have you noticed in the T&C's you can only make 5 lifetime claims! So what happens after that, I guess you don't buy from marketplace after that, if you have been unlucky to have to claim 5 times.Everything has its beauty but not everyone sees it.0

Well as a fairly large seller on Amazon I have only had one claim (any other problems are sorted out prior to a claim). In my case the buyer was at it and being unreasonable however I explained the situation but Amazon really insisted on a refund and kept pressurising me. Eventually (a few days) I gave in and refunded.
The point is I refunded before Amazon did on my behalf so it might take a while.
If I was you OP I would give Amazon a call and see what they say. You can then decide whether to open an A-Z claim straight away or give it a few more days.
As to niccy all items are listed on Amazon via EAN number if the item is fake then the EAN number will not be correct and thefore the seller has defrauded you (proving it might be an issue) and you should be able to get redress through Amazon.0 -
I have been waiting over 20 days for an item from Amazon market place to arrive and the seller has totaly failed to respon to my questions, I need to wait another 3 days before I can start my market place claim and they say it will take upto 2 weeks. woudl it be quicker to get a claim back via my credit card.
does anybody know why amazon has such a bad reputation for protecting its customers from this problem, and if they plan to do anything about it.0 -
What is your seller saying? Have they responded at all, what is their feedback like?

The guy who recently advised non-receipt from me waited oooh.... a minute after emailling me before opening an A-Z claim.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0
