Timeshare Con!! Does Section 75 apply

Hi, hopefully someone can help.

In September my elderly father received a call from a Company offering him the option to purchase a two week holiday for £199.00. During the call he was informed that the two week holiday could be taken within the next three years and in addition to this, at no additional cost, he would receive a European City Break, staying in 3 or 4 star accommodations. My father was informed that the company was affiliated with RCI, a reputable Company whom he is currently a member with. My father was reassured several times that neither break was at all connected to the sale of timeshare.

My father has, in the past, received several calls from your Company and at this point he decided to proceed with the purchase. After making the transaction using a credit card, it took five calls to to obtain any documentation regarding his purchase. We have now received confirmation of the purchase along with the City Break Voucher. A separate piece of paper sent with the voucher states that to take advantage of the City Break, a further £59.50 per person is required, along with airport taxes and processing fees. It also states that you cannot guarantee 3 or 4 star accommodation and a presentation must be attended to show the benefit of timeshare/ownership. All these details were omitted from the telephone conversation with my father even when he posed the question. It also appears that they also have NO affiliation what so ever with RCI.

I feel that the Company neglected to inform my Father of the true facts at the time of the sale and he was bullied into making a decision over the phone.


I have contacted the Company several times by telephone and on each occasion I have been treated with abuse. I understand from the terms and conditions, only made available after the transaction was completed, that no refund is available. The Company is in Spain. Would I be able to claim the amount back from the credit card Company????

    If you have had no luck getting this sorted out with the company direct, I would get straight on to the CC Company and file a dispute.

    I have now received a reply from my fathers bank (HSBC) and they have refused to refund the monies stating that my father did not ask the correct questions at the time of purchase! Any further advice would be gratefully appreciated. x
