reclaiming from the ulster bank. help anyone?

I have put all my letters in to the ulster bank - they refunded me partly wrote back to them and told them i would start court action if they didnt pay the remainer - they told me to go ahead.
Started court action - claims pack has been sent out to them - they have until tomorrow to respond. Does anyone know what happens next if they dont reply?
Any help would be appreciated

    I suspect that they will reply and ask that the case be stayed pending the OFT test case. If they don't you can ask the court to decide in your favour by default(ie they have not responded). However, the likelyhood would then be trying to enforce the judgement and the likelyhood of the bank asking for the default judgement to be overturned and then stayed by the court. It is a lot of ifs and buts until they actually respond.

    Hi i would say this is very likely, i did have a sucessful claim against UB last year ,for my parents, i was over £6k and i didt it via the civil bill route which was so straight forward, the UB send a letter offering them the full £6k the day before the test case was announced, the very next day the also sent out the "on hold, stay pending due to OFT letter", but they had to honour the claim, but they did try to talk their way out of it,

    Sorry i forgot to mention this is for credit card charges not bank charges - will that change things.

    If it's bank charges, then the only way you will get an offer is if you are in financial hardship.
    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?

  • Hi I'm new to forum also but my question is - does anybody know if the same rules for reclaiming charges applies to The Bank of Ireland? Has anyone reclaimed from them? I'd appreciate any advice please.

    you won't and you will have to wait for the conclusion of the OFT test case issues.
