    I haven't got much experience in which charges you can and cannot claim, but surely this would take ages and by then the interest (which she definitely cannot claim back) would mount up to Mount Everest hight.
  • If I were you, I would just pay the £120 the CC company states is needed to get back below the credit limit so she is not charged anymore and then make sure either she or you check the statements MONTHLY from now on to ensure this doesn't happen again.

    She signed a credit agreement which would have clearly stated the charges which would have been applied if she exceeded her credit limit, you can't then expect the CC company not to apply these charges if she breaks her side of the agreement. The whole reason they impose these charges is to try to stop you exceeding your limits, otherwise why would anyone stay inside their credit limit if there was no penalty to pay?

    I agree the charges are a rip off, which is why I make damn sure I never get near my credit limit, if you feel the same then the simple answer is stay within your limits in future

    Don't get me wrong, I think she needs to get herself back under the credit limit ASAP na dpay the £120 required. It is worth attempting to claim overlimit charges back though to reduce the overall balance.

    How much are the charges for? Most (all?) cc companies now charge a £12 fee per transgression, which has pretty much been agreed with the OFT as fair. If the charges are over this you could try to claim them back, but this is a long process so in the meantime you should pay to bring her back within her limit today, as interest is calculated daily. Remember it will take two statements to show all the interest due, so make sure you overpay to ensure next month you aren't overlimit again.

    Although £12 is genarally agreed as fair I have successfully claimed £12 charges back so it's worth a try.

    considering what they put in their mc flurrys it might be better for you if the warning said remove mcflurry before eating

    I think the issue is, her statements told her to make a minimum payment that was inadequate to bring her back within her credit limit and so prevent another over-limit charge being applied. I would suggest that this constitutes a breach of the card company's duty of care. And in simple fairness, since her use of the card took her over her limit once, only one over-limit charge should have been applied.

    All that she can do about the interest is just pay down her debt, unless she can transfer the balance to another card. And if her account has been marked as delinquent for every month that it has been over-limit, then her credit rating is probably in shreds by now.

    I think you'll find all credit agreements state that if you go over your limit you must immediately make a payment to bring it back into line.

    If you choose to make a payment that takes you 1p (taking it to it's extreme) under your limit, then it's really quite obvious that you'll be overlimit again next month when they add the interest.

    At the end of the day, card users need to realise that the limit is just that...a limit. It's not a target to be achieved...and then beaten!
