Payment Protection Plans

I have a mortgage payment protection plan that I took out 2 years ago. I now realise that the conditions say I would not be able to claim for unemployment if I was in receipt of State Pension when I took the policy out, I was and the provider was aware of this. When I rang the company 2 weeks ago I was told that I would be able to claim if I could provide proof that I was still looking for work - CV sent out etc. Because of my age I would not be able to `sign on' and obtain the normal evidence. I asked them to write and confirm this but to date, and despite a follow up call 1 week later, I have not received the confirmation. I don't want to leave myself vulnerable but have only 20 more payments to make on my mortgage and really don't want to continue making payments for insurance that will not pay out if I need it. Has anyone else come across this problem, and would I be able to claim my payment back as the insurance was `mis-sold' to me?
