Vehicle Accident Claim - Can I Claim Against Anyone?

Hi folks

I’ll try and make this as brief as I can, travelling on the motorway this morning around 05:30 am, I suddenly hit a solid object in lane 3 (fast lane) my car stalled, but managed to get onto the hard shoulder, several cars behind me also hit this object, resulting in I would guess around 10 vehicles ending up on the hard should., it felt as though I had hit a raised manhole cover or something very similar.

On inspection of my vehicle I found both the offside front & rear tyres had gone, including damage to both alloys.

My vehicle was relayed back to a tyre centre where both tyres were replaced, on a test drive the mechanic noticed my vehicle was pulling to the left, also vibration, and a wired noise coming from under the front offside.

Due to the safety aspect, I contacted my insurance and have arranged for my vehicle to be assessed by one of they’re repair centres, now to my point, I have a £200.00 excess on my policy, and just paid £190.00 for the 2 tyres to be replaced, is there anyone I can claim against for this?

This claim will obviously affect my NCD, and as you can see from my signature, I’m on a very fixed income; I just don’t have the money to layout as described above, any help / guidance will be very much appreciated.

Finally, this incident has been recorded by the Highways Agency, including all the vehicles involved, the motorway was shut down briefly to enable to foreign object to be dragged off the main carriageway.

  • Call the Highways agency and ask them; although it may be the local authority that is responsible for that stretch of road but the HA will tell you that.

    Unless you find the vehicle that dropped the item I don't think you will get anywhere. #whilst the Highways agency/Local Authority are responsible for making sure the roads are safe, they cannot patrol all the time.

    If other people hit the object after you, but there was no one before you then it is likely the object was resently dropped for a vehicle.

    Chances are you are going to have to pay for this one yourself.

    The insurers should pay for the tyres. I say "should" - its been around 18 yrs since I dealt with motor claims.

    As Uktyler says, very little prospect of recovery from a third party. Only hope might be if the police attended and managed to trace the offending item.

    Motorways have nothing to do with the local authority.

    They are 100% Highways Agency.

    Unless you can positively identify the vehicle that the object fell off, then you have no recourse other than from your own insurance. That's one of the reasons for having Fully Comp. Observation is usually a good idea. You should drive at least 2 seconds behind the car in front. At 70mph that is 60 metres or about 12 car lengths - not 1-2 car lengths as is common on motorways....

    As the cost of your replacement tyres is less than your excess, DO NOT even phone your insurance company to ask about this. They will probably treat such a call as a claim (they don't need much of an excuse to do this) and your premium will probably go up next year by more than your claim anyway.

    By the way, there are NO manhole covers on any motorways in the UK, other than some on the hard shoulder.

    Having passed my driving test in 1979, I don’t need any lectures on motoring thank you very much, but for you information, I was overtaking a HGV in lane 2 I was between lanes 2 & 3 when the incident happened, as there were no overhead lights, it was almost impossible to have seen the obstacle, had I noticed it, I would have taken preventative action!! .

    Sorry, misread your post. May have been something to do with the vile colour and unnecessary font formatting.

    Your paragraph 4 could be read such that the outcome of the inspection was that you needed two tyres which cost £190 and this is less than your excess. Expensive tyres if you're on a DMP as well....

    As for paragraph 3, what is a wired noise? Sounds a bit wierd to me....

    Wrong, not all motorways are the responsibility of the Highways agency, I can say that categorically.

    Dude,

    What I think you will find is that your insurance company will deduct the £200 excess from repairs done to put your car right.

    The 'temporary' repairs you had done are also covered.

    So let's say it cost £500 to repair your car - then you pay the £200 excess - the invoice for the tyres etc - the £190 - should be reimbursed by your insurer.

    However if you do not have any other repairs done over and above the first £190 then you are not going to get that back.

    Clear as mud?
