Dying Father Ripped off by Convicted Fraudster With Stopped Cheque. Legal Position?

    As your Father cashed the first installment,this rather indicates your Father" accepted "these terms? Rather than being shocked that the first cheque was stopped,he has "seemed" to enter into this next arrangement willingly? Is that correct?

    Did the agreement state how every installment was to be paid? specify cheque?
    When you late Father was alive ,did you enter into any dialogue with the buyer ,that would contradict that your Father was not paid any more? And how did the buyer respond then?

  • I dont think the police will be interested.

    A friend has a tile company and someone ordered tiles from them and paid by cheque. The tiles were well over the guarantee limit, and they were told they could be picked up once the cheque had cleared.

    They arrived the following day and asked the sales person to cancel the delivery as they had their own van with them, and were 'ahead of schedule and needed the tiles sooner'.

    The sales person gave them the tiles, and off they went. Some time later the bank returned cheque saying it had been cancelled.

    Friend contacted the police, who said it was nothing to do with them, then drove to the delivery address where no one answered the door, but there were clearly people doing work inside - and the offcuts of the same tiles were in a skip outside.
