C1 form - guidance used by the officials dealing with the form
I put in a Freedom of Information request to see the guidance used by the officials. If anyone wants to see this please DM me. I must admit that the information seems less specific than I expected, certainly it does not address the use of the rather archaic language required for the Declaration. I also find it strange that…

House title in one name only and care home fees
My parents are married and in their early 80's. Unfortunately mum has recently had to go into a care home as she is not on her feet and has dementia. The care package has not been worked out yet and she is still under free NHS care for a few weeks more. Sadly my dad has recently found out that he is terminally ill. He…

Who is in the wrong - me or my brother?
The background: Our dad died fairly unexpectedly in December, with no will. He was terrified of death and dying and was too superstitious to make a will. My brother and dad lived together with an elderly lady for the past 19/20 years, who is like our surrogate nan and was like my dad's surrogate mum. I live round the…

My dad passed suddenly, I would be ever so grateful if anyone can help with any advice
Good morning, wondering if anyone can please help with a little advice? My dad suddenly passed last Tuesday

Wills with solicitor as named executor
My parents had mirrored wills drawn up by a solicitors firm. My dad has just passed and I've discovered the solicitor made themselves executor (or the firm if that solicitor has moved on). My parents probably thought this would save me a lot of hassle, but it means the firm can now charge them for any legal action required…

Will HMRC process probate within their 8 week timeframe?
Got an email from HMRC when I applied for probate. It said this: What happens next. We will contact you when we have received your documents. We will then review your application and issue your grant of probate within 8 weeks.Yeah right...except (and much respect to them) that is exactly what they did do! The day before…

Do I need a new Will?
Having recently married I am adding my wife to the title deeds of my house which I owned before the marriage and we now live in as our main residence. This wasn't something we had previously thought about as she owns another property that was her home before we started co-habiting. My current Will states "Upon my death I…

IHT423 & NS&I
We have a small (approximate 5%) balance left to pay for Inheritance Tax. It is the sum we requested NS&I to send directly. NS&I state they are currently only dealing with correspondence received before 19 March, our letter was received by them on 22 April. (sent via tracked letter so we know this is the date they received…

Contesting a will/expression of wishes
my father passed away December 2025. years leading up to my father‘s death he was very expressive about his will which we saw and was discussed on numerous occasions. He remarried three years ago and his wife told us on numerous occasions she did not want any of his money as he has his own. His estate has now gone to…

Cash inside intestate property not declared
As part of intestate rules, no cash inside a property is part of the estate to be retained as chattels/personal possessions of the surviving spouse. I was informed by the deceased, several years ago, that a considerable sum of money was kept in their safe inside the property. What can I do do ensure the safe is checked and…

Making a will
hi all, I live in France but I have a house in the UK that I would like to leave to my son when he’s reached a certain age. My UK bank account and online bank account also to be left to him. My French assets would be subject to French law and are jointly owned with my partner anyway. It’s just my UK stuff I need to sort…

Probate error of about £10k. How much trouble am I likley to be in, please?
Hello, I made a daft error in am probate application, which I only spotted the day I got the probate certificate back granted. It's a small will, with no property, and no inheritance tax. Essentially, I broke a formula on the spreadsheet used and missed a row, and while it should have been obvious, I didn't see it. I gave…
