    Hello!

    We recently parked in a Euro Car Parks (ECP) when on an emergency visit to the dentist after our 6-year-old smashed his front teeth in a fall at school.

    When we got to the car park we put £3 into the parking ticket machine and it did not issue a ticket, it also didnít give us the £3 back. As we were in a hurry and a little desperate, we tried using a card payment to buy the ticket which also would not work, we tried another machine to no avail, so we took a picture of the machine and headed to the dentist for the appointment, figuring "Well they have our money, so they can hardly try to charge us for not paying"

    Naive, I know. But by rights we did pay, in fact we over paid.

    So today we've received the PCN trying to invoice us for £100 which is laughable, but I don't know if I should appeal or ignore, in my eyes I've (over) paid for my stay on their car park and it's not my fault their machines arenít being maintained properly or had a fault coinciding with our visit.

    Would you not include the fact the machines were not working? Signage was legible but I'm guessing this is a standard response for a POPLA code?

    as long as the driver is not divulged you can add a paragraph stating that

    THE DRIVER HAS INDICATED THE MACHINES WERE FAULTY ON THE DAY AND ALTHOUGH THE CORRECT MONEY WAS PAID TO PARK , NO RECEIPT WAS GIVEN

    or something like that

    you are no expert on signage and over 90% of the signage in the UK fails the relevant CoP and/or consumer laws etc

    you have no idea if advertising consent or planning permission for the signage and cameras is in place either

    query everything , accept nothing

    Will persue this all the way I think. They shouldn't try to invoice me when their machines took my money then literally wouldn't let me pay again.

    Hello,

    I sent off the challenge nearly 2 months ago now and haven't received anything back, I'm worried that they might be slapping a debt on my credit file in the background or something.

    Shouldnt they have responded with a POPLA code by now?

    Is there a time limit for them to respond?

    As your research will have told you, nothing can happen with your credit file unless you have a CCJ against you, meaning they have to have taken you to court and you have lost AND you do not pay in full within 1 month.

    They still have not responded so I'm going to guess they've decided that A) The machine was a few £ better off that day, which equals what I put in. Or, B) It's not financially viable to pursue this any further.

    Either way they've not responded for just over 2 months and if they have to respond within 35 days they have most certainly missed that boat.

    If this was online (we hope) then chase it in case you missed a POPLA code. Don't assume!
