Please help - Court summon VCS 3rd Dec 17 at 9:24 PM
Hi, could anyone please help me thanks

Have read the newbie sticky post but still finding it difficult to understand how to defend the case. Have been working away and do not have much original paperwork from VCS. On colleagues advise have not communicated with company which in hindsight looking at posts may not have been a good idea,

The vehicle I own received a charge for overstaying at a retail car park in July 2017 where it is free to park. Not sure who was driving at the time.

Received court papers dated 29 November stating particulars to follow. They arrived dated 29 November envelope franked 30 November. Have gone online and acknowledged papers but am so close to thinking should I pay. Not very good at constructing legal arguments.

    Any help great-fully appreciated. Thanks

As they seem to know so much, how are they helping you to deal with this? They do need to take some responsibility for their appalling advice.

That’s the best information you have to deal with this - particularly post #2. We are not a legal advice forum, we primarily advise on dealing with private parking tickets at base level, not the end stage where the courts are involved.

But a small number of people here can give some advice, but it’s based on much of the legwork being done by the individual against whom the legal action is being taken.

Please note, this is not a ‘summons’. It is purely a civil case, not a criminal one.
We cannot provide you with a silver bullet to get you out of this. You have to be in for the long run, and need to involve yourself in research and work for you to get rid of this. It is not simple. We will help, but can't do it for you.

Give a man a fish, and you feed him for a day; show him how to catch fish, and you feed him for a lifetime.

the new paperwork should have full details on the claim , known as the Particulars Of Claim , or POC , which came in on 01 oct 2017 due to the newer PaP (Pre Action Protocols)

if it says these will follow within 14 days , then follow the advice about drafting your defence to the MCOL (its an MCOL, not a summons)

if the PoC are with the papers, then do the AOS and start drafting a defence

it also seems strange that this has happened in only 5 months , usually claims would be for 2016 or earlier (up to 6 years)

that post #2 is the best free advice you will find anywhere, but nobody said it was an easy topic

Private Parking ticket? check the 2 sticky threads by coupon-mad and crabman in the Parking Tickets, Fines & Parking Board forum for the latest advice or maybe try pepipoo or C.A.G. or legal beagles forums if you need legal advice as well because this parking forum is not about debt collectors or legal matters per se
