ESA Support Group And Received ESA50 14th Aug 17 at 2:07 AM
Hi i am in ESA Support Group for 4 Years. Two months ago i changed address and moved out from my partner and now i received ESA50.

I am terrified i have severe depression sleeping disorders social anxiety panic attacks and post traumatic stress due to serious assault on me in the past. Now i also diagnosed with Autism Asperger Syndrome and obsessive compulsive disorder.

I am taking Propnolol 40mg, Citalopram 20mg, Amitriptyline 10mg, Vitamin D caps and Gaviscon.

I am now really depressed and going through a lot of stress, i only have 28 days to fill the form in and send it back. Last time cab people helped me to fill the form in but now its been long time since i saw them and hard to get hold of the person who helped me fill the form in last time.

I am totally lost and cant thing right what to do, any advice would be much appreciated. Thanks

There is no regulation that allows for an extension.

There is a Regulation which states that a claimant will be treated to have No Limited Capacity to Work if the requested information is not recieved within the prescribed time limits.

Any DWP employee who strays from this path is not following the law. What should happen if the deadline is reached is the case should be referred to a DM, if, by the time the DM gets the case, the form has not been received, then the claim should be closed. Subject to being reopened when it is received. There are no exceptions, the DM is not allowed (under the law) to say to himself, "oh look this claimant called us on 14/08/2017 and said it would be late, and the person they spoke to has put a note on saying they can have an extra 14 days, that's ok then, I will not close the claim." They are simply not allowed to do that, the facts will be
    * What is the deadline?
    * Has the form been received by that deadline?
If the answer is "No" the claim must be closed.

Who gave you that advice? Was it the person you phoned or a person who called you back from the BC? Either way, you took a risk in trusting them. That risk would be mitigated if they put a note on your file, which you wouldn't know if they had done or not unless you phoned back 30 minutes later and asked someone else if a note has been put on your file dated today.... and what does it say. The worst that would happen (if there is a note) is your claim would have been closed, but when your form was received the DM would have considered that a DWP person gave you incorrect assurances and they would re-open your claim.

The worst that would happen if there was no note on your file of the conversation, is that your claim would have closed and been refused to be re-opened, and you would have to make a new claim. You would not be paid for the gap between your old claim being closed and the date the form was eventually received.

i have copy of previous esa50 form, i had f2f assessment in 2013 but that time i was only on one anti depressant now i am on three different anti depressants and beta blockers.

In 2013 i was not diagnosed Asperger's syndrome in 2014 i diagnosed Autism Spectrum Disorder. I have A a lot of letters from Autism people which i can send as a proof i will ask for more supporting letter from them.

My only worry is that the person i saw last time in CAB is so busy and also my GP too and i only have less than 28 days left so all i need one supporting letter from GP and cab appointment on time

You can send it on to CHDA after the ESA50 as soon as you get it, with a covering letter asking for it to be added to your file. You could also email and given them notice you are sending additional evidence to be considered once the letter is ready.

Re deadlines, I got my last ESA50 in December, rang DAB immediately and couldn't get an appointment with them for 3 weeks. I asked Maximus if i could have a one week extension due to slow post & delayed help and that was granted. Done via email so I had proof in writing.

    Email address is here:
    www.chdauk.co.uk/contact-us

As long as the ESA50 is filled out soon I don't see why you need an extension, nor why one would be granted.

Medical evidence can be sent along later

    [Sample email]
Your name, address & NI number.

Dear sirs, I sent back a completed ESA50 to yourselves on (DATE) along with medical evidence.

I now have additional medical evidence i wish you to consider in relation to my claim, which will be posted today.

Please ensure this is added to my file.

    [end]

Print out the email and include a copy in the envelope with your additional medical evidence.

    Update:

I sent the esa50 with medical evidences on 29th Aug, and they received the form on 6th Sep. Today i received the letter from DWP dated 7th Sep saying that we have looked at your claim again, i was happy that i remain in support group but when i rang DWP then i been told that its nothing to do with reassessment as it just computer generated letter.

The letters usually start of with "We have looked at your claim again due to a recent change....." the letters will go on to say "You will receive ESA £125.55... this is because you are in the Support Group...." etc etc etc.

You can now wait for CHDA to decide if they want to see you for a face to face assessment..... you can phone CHDA 0800 2 888777 to confirm that no decision has been made yet if you are to have a face to face assessment...this will then confirm to you that you have been advised correctly that this letter is nothing to with the re-assessment.

i thought the maximum ESA award was for 3 years?

i was sent an ESA40 at the beginning of May. sent it back within the week and heard nothing.

honed in the middle of June to be told it was sent straight back to a decision maker.
received a letter on 14th July saying supper foe again.

    11th august received an ESA50.
phoned and asked how long my award was. 3 years.
    so why another ESA50?
input into the system incorrectly and ignore it.

will wait a month nd see if they suspend benefit i suppose

If I were you, I would -just to be safe and avoid potential hassle of a claim closure, which you might have to man recon to get re-opened.- I would phone CHDA and ask them "Is there a live referral for ESA?"
If they say yes = alarm bells should be ringing in your head.
If they say no you should then ask "was there recently a live referral made around 10/08/2017 which has now been closed, what was the reason put for the referral withdrawal? i.e. because it was in error?" If they confirm it has been closed because of error, then you can sleep soundly.
