    I am so scared I have just completed one of these for a non potentional or a potential payment arrangmenet. I am now 6 months into my bankruptcy

    Is this SOA both you and your partner and who is actually BR - you or both of you?

    There are a few things:
    Gas debt - is that debt accrued since you went BR? If not then you should not be paying any arears as it should have gone into your BR if the account is in your name.
    Alcohol and e-cigs wont normally be permitted
    vets insurance - some ORs wont allow this
    Vehicle finance - assume this is your partners not yours?

    Like I say - unless we who is BR and whose income is being assessed its hard to advise.

    sorry I am bankrupt no financial connection to husband he is not bankrupt. Gas also debt from old house after bankruptcy we have since had to move I will recalcute thanks

    Hi


    I hope this makes sense.


    I am bankrupt just come back part time from maternity leave I told the of this as wanted to be honest.


    They didn't take a ipa off me due to maternity pay which has left my hubby in more debt so I had to come back early.


    I'm scared out my wits incase they expect me to pay massive amount back im happy to pay a small amount back.


    When I was on maternity leave my official received said I was paying 26% towards the household but I said surly now my circumstance have changed my hubby has his own debts and 2 children from his previous marriage and we get them 2 time a week to stay and then extra during holidays.


    hope I have done this correct. I havnt included his debt or his car lease amount of 150.00 per month shall I do this again?

    If its only you who is BR then the SOA should just show your income and expenditure at 26% of the totals so for example if the rent is 650 them your expenditure will be 169. As you are now back working, you are earning approx. 50% of what your partner is earning - has the OR revised your 'share'?

    IPA's are not normally back dated - if the OR changes your IPA then it will be paid from that point on.
    Your partners debts are no concern of the OR's so the OR will not normally allow you to pay less IPA because of hubby's debt.
    Entertainment is rarely allowed but of course hubby can spend his money on what he likes as far as the OR is concerned.

    I don't have an IPA at the moment. She is gonna work it out as I was previously on benefits maternity pay. No she hasn't worked mine out the 26% is my share I paid on maternity pay. I pay all the childcare out of my wages as hubby can't afford it out of his.

    Thanks for your response because I earn like you say nearly 50% of my hubby wage surly he or should expect me to being approx nesyl50# of bills is that corrrct and true the 26% I was paying my share when on maternity leave. I have no IPA as of yet just scare as got the paperwork through. I was honest and told them I started back.

    I have heard I don't have to accept the IPA if I think it's too much and I will go to court and explain my position. If it expects hubby to pay more household and gold are he won't have enough for his other kids and debts which will put him in worse potion. X

    debtdoctor is the best at advice on IPAs but it is true you can go to court to dispute it. Personally I would be wary of that unless it is truly unreasonable. As I say - the OR isn't interested in your partners expenditure and is unlikely to support a reduced IPA because he is in debt.

    I am happy to pay something back eh oh I can afford but I can't let hubby pay for everything. I pay 400 a month th childcare costs as he pay most of bills. Hopefully I won't get an IPA. I'm working with cuz I tend advice tomorrow on completing forms. I think she should share my household half with my hubby. If all ends she will force me to quit my job I mean o my if it's a stupid amour they want back. I was think I could afford 50 a month
