    Hi

    Ok I have tried to read the newbies thread on old or new fines,however I have a problem with my software so I am unable to read this currently, and I cannot read this on my phome so my only option is to post to see if I can get any swift responses....apologies

    UKPCS have sent a letter today, all correct details, name address etc, except that I was in a different town when they are saying I was there, I popped in for a takeaway coffee and then left, they are saying I was there for longer than the stated timings!!

    Do I ignore the letter?? Or do I have to take some sort of action as do not want a CCJ they are not a member of the BPA so I'm not sure what to do

    If you were pakring fine, then why have they given you a pakring charge notice?

    Was this a window ticket?
    why did you get a ticket?
    what type of car park is/was it?
    residential,?
    pub?
    shop?
    shopping centre?
    retail park?
    other?

    No window ticket just a letter through the post

    It's a small retail park

    We went in to get a takeaway coffee on the Monday whilst leaving place of work, then drove to another town, we clean the same place across the road from the coffee shop so went back the Tuesday and got a coffee and they're saying we were there all night, that's it...went back Wednesday etc and so on, we go for coffee everyday after place of work, although takeaway!!

    as its UKCPS , you just appeal once with the IPC template

    they will refuse to cancel, then its stalemate

    no different than the hundreds of other IPC member invoices issued every week

    which IDIOT told you its a "fine" ?

    you only get a CCJ if you fail to pay the court judgment if you lose in court

    so pay up promptly, if you lose in court, and no CCJ will follow

    the template is in the NEWBIES sticky thread near the top of this forum

    no , do not send recorded delivery , they could easily refuse to accept it

    send first class from the P O Counter with a free certificate of posting

    ignore everything after that apart from an LBC , or an MCOL from Northampton

    No, you send it by whatever method it tells you on the PCN as near to the appeal deadline as possible. If there is no option to send it online, or there is no option to appeal as keeper, then send it first class from a Post Office counter and obtain a free proof of posting. Do NOT send anything by recorded delivery.

    I cannot access the newbies thread as my computer software doesn't support it, am trying to do it on my mobile but getting no-where, I've read the recent threads on the same company

    It's all a bit confusing, as I did not get a window sticker just a straight letter

    Could someone confirm if this is the correct letter to send please as currently it is all a bit of a mess accessing it on my phone

    Do I need to change anything at all? And I have to post it as I don't believe they have an appeal form or any email correspondence at all

    The letter starts with

    Re PCN number, informing them I am the registered keeper but not to give driver details?

    If anyone could copy and paste it, that would be much appreciated, just the first paragraph so I know I have the right details on my phone

    I too would advise you to NOT USE A PHONE

    but to move this along I will copy and paste the info below, just this once, but for further help use a laptop or a pc , not a phone (I am using a laptop in order to help you , we expect the same courtesy in return)

    and dont expect this to "work" they wont back off at this stage , its a potential 6 years of hassle after this step

    Template appeal for IPC members - copy this wording into the online appeal box or into an email:


    - if this is an IPC member parking firm, see post #3, there is no POPLA for you, so consumers do not get a fair appeal. Instead, just send this letter or a version of it, writing ONLY as the registered keeper, with their name and address (thanks to salmosalaris for the basis of this letter):


    Dear {name of IPC member - only IPC members for this version!!!}

    Re PCN number:

    I am the keeper of the vehicle and am aware of your purported 'parking charge'. The driver will not be identified. I require the following information so that I can make an informed decision:

    1. Who is the party that contracted with your company and are the the landowner?
    2. Is your charge based on damages for breach of contract? Answer yes or no.
    3. Please provide photos of the signs that you say were on site, which you contend formed a contract with the driver.
    4. Please provide all photographs taken of this vehicle.
    5. Please provide proof that the timing of any camera or timer used was synchronised with all other cameras and/or systems & machines.

    Do not send debt collector letters and do not add any costs, which would be a thinly-veiled attempt at 'double recovery'. I will not respond to debt collectors and to involve a third party would be a failure to mitigate your costs as well as deliberate and knowing misuse of my data.

    Should you obtain the registered keeper's data from the DVLA without reasonable cause (e.g. if you do not fully comply with the IPC Code of Practice in terms of signage at this site, as seems likely based on my research) please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me. I do not give you consent to process data relating to me or this vehicle.

    I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.

    You can add to the template above, 'in order to resolve the dispute I attach copies of...': the driver's receipts/bank transactions (or Hospital Appointment/Hotel booking, etc.) that day as 'they' were a genuine customer/patient, etc.
