    I am selling my flat which I own in a big complex. The buyer's mortgage company did a survey and it came back as my flat being a HMO? Not sure how they managed to come up with that considering it is a 2 bed flat in a city centre. I believe it was Barclays who did the survey. The estate agents just said that they are speaking to the council to rectify it. Is there anything I can do?

    Probably Section 257 HMO, nothing to do with occupancy and nothing you can do to "rectify" it unless the surveyor was mistaken.

    Assuming it is a section 257 HMO, do Barclays see it as a problem for the mortgage?

    Essentially, a section 257 HMO means the building was probably converted to flats a long time ago (before 1991?) and so it doesn't meet current building regs - plus more than 1/3 of the flats are rented out.

    So it imposes extra responsibilities on the freeholder/manager (but no real extra responsibilities on you as a leaseholder).

    It's an apartment complex in Birmingham built in 2002.

    I imagine most of the flats are rented out but it wasn't converted.
