Failed appeal to Parking Eye/Popla 23rd Feb 17 at 10:36 AM
Bitterly disappointed after reading the email popla sent informing me of my failed appeal, I felt I had a reasonable case. Just to add I found it rather strange when viewing parking eye's case to popla which included details of a case they won in court. Can I have some advice please as feel I should take this further?

    you cannot take it further

all you can do is argue it again , in court , if or when PE issue an MCOL within the next 6 years

ie:- you have no control over this case , PE do

Just a shame you didn't run your POPLA appeal past this forum before submitting it.

Yes I wish I did now, I tried not to put too many details in and kept it as simple as poss, still felt I had a good case though.

What exactly were your appeal points?
You may or may not get court papers now from PE depending on their contract with the landowner.
Don't bother about dent recovery letters though.

Aldi might not cancel but the good news with those sites is, PE never sue.

Most other sites, PE will sue but there's scope for complaint to the landowner or Management (e.g. if at a Hospital, complain vociferously to PALS - Google it - or if it was at a Motorway Service Station, complain to Welcome Break, if at a Hotel, complain to the Hotel Manager, etc.).

Hello again folks, it was Boots eye test shop car park, big clear signs, as Halfords had next door, stating for customers only. Originally Halfords was where I was going to park as done many times as was shopping there too but articulated truck blocking entrance as waiting to get into depot. I called in Boots to enquire about walk in eye tests as my glasses due upgrade. Ironically I could not see the sign with small print instructions requesting you enter your number on screen in shop. The main, and easiest sign I would have seen was totally blocked by a high side van wrongly parkedas I realised on second visit after I received the letter from pi, even so, all small print signs had cars parked in front of them so therefore could not get close enough to read. I felt I had no problem as I was doing as large print warned re parking for customers only.

Right, so did the Boots manager cancel this offending PCN when you complained that their staff are failing to point out a hidden small print sign about using a screen to input a VRN? The staff should be doing this FOR people. You have complained, of course? Take the PCN in and rant.

No, not just any random member of staff. The Manager.

The fact they have a screen for VRN input in store, shows it is to do with them and we know PE always issue retailers with a phone number or email and they CAN cancel. I bet that Boots Manager cancels these all the time.

Cant believe this latest update, got another letter from PE yesterday with 14 days to pay £100. Called boots opticians again the manager emailed me back with this.....
My manager has spoken to parking eye and they have not cancelled it from our request because you have already appealed it through a private company which overrides a cancellation from us. Jenny has tried to ask them to do it but they have said she cannot override the original appeal.
The only thing I can suggest is getting in touch with them again.

looking at this PE will issue an MCOL so start drafting your defence asap and put it on here for critique

read up post #2 of the NEWBIES thread so you know what to expect and complain direct to BOOTS CEO and/or Head Office, in writing

try and get them on your side , especially if they are the landholder. if there is an MCOL , pay the Land Registry for landholder details and contact them (if different) and try to get it cancelled or a letter from them stating they do not wish this to go to court

dont wait until the last minute and then come on here in a panic
