    Hi,

My received a parking charge notice from the above company as a Notice to Keeper stating pay £100 now or £60 within 14 days.

This time period of 14 days has expired due to holiday, cannot find any information about this company and would be glad of some advice please?

    Thanks

Keeper data was applied for on same day as alleged offence, 24-06-16 by S Cohen.

The date of alleged offence was 24-6-16 and the NTK was sent on 14-07-16 and received by us on 17-07-16.

Acknowledgement sent off but no court date given.

Think I need to send a defence in within next 14 days, any help will be greatly appreciated.

    Thank You all.

Does the paperwork allege Keeper Liability (some do) and if so, you should be onto the DVLA ASAP.
Life's for living, get on with it rather than worrying about these. If they hassle, counter claim.

Send them that costs schedule though, 24 hours before the hearing, and file it with the court. Take with you evidence that you have sent the costs schedule to them and when.

They are outside the 14 days to hold the Keeper liable so you should drop a line to the DVLA asking them to investigate the false claims on the UKPE paperwork. Will save you a lot of hassle if you get the DVLA on your side.

    Hi everyone,

have had a letter from Gladstones solicitor saying the following.

We act for the claimant and have notified the court of our clients intention to proceed with the claim.

Please find enclosed a copy of our clients completed directions questionnaire, which will be filed with the court upon their request. You will note we intend to request a special direction that the case be dealt with on papers and without the need for an oral hearing.

This request is sought simply because the matter is in our clients opinion relatively straight forward and the costs incurred by both parties for attending an oral hearing would be disproportionate. We trust you agree.

You will note that our client has elected not to mediate. its decision is not meant to be in any way obstructive and is based purely on experience, as Mediation has rarely proved beneficial in these types of cases. Notwithstanding this our client would be happy to listen to any genuine payment proposals that you wish to put forward.

    That's the letter verbatim.

    Any thoughts please? Thanks.

All covered in the guide to court you'll find in the newbies faq thread

You want a hearing! (No to their request and no to mediation)

Read all the other threads about the 'oral hearing' and the misleading N159 form they enclose.

    Search the forum for N159

    Hi
Am hoping someone can help me here! My boyfriend has just received a parking ticket from UKPE for parking in Aviator Way near Manchester Airport. He did stop there, for about 5 minutes, after he dropped his Dad off at the airport while he put in my post code to his Sat Nav to find his way to my flat.
Can they give a parking ticket for being there for 5 mins - he said he didn't park in a car park, just pulled into the side of the road. Also, they have sent a photo of his car at a junction so not actually parked.
    Any help would be appreciated.
    Thank you!

You need to start your own thread. Answering two people in one thread will just lead to confusion.

Hi everyone, thanks for the support.

Missus got a Notice of Allocation to the small claims track where within it said that Claimant had to pay the court fee and complete application by 26th September at 4.00pm which I now find by contacting the court that they have..

The Hearing is set for 10am on 24th October 2017 at Manchester and I am looking for guidance and advice as to what to do next please?

    Many Thanks

I know that they have not had much success in court recently - their NtK were deemed by my judge as not compliant with POFA, but the signage and landowner authority is still up for debate though.

I also know that a large number of the claims against one of the tenants at Regus were dismissed at Manchester about 6 weeks ago. Nobody from Gladstones or UKPME will turn up, I had a rent-a-lawyer from SCS/LPC who, in hindsight, I could have challenged on rights of audience, but I wasn't 100% familiar with the ins and outs of it.

I also know that a certain private parking appeals company who are recommended by Parking Cowboys have had a lot of involvement with some of the other claims that UKPME are pushing through for that location - it may be worth making contact with them as they already have a lot of the background information and evidence packs.

So you need to show is your Witness Statement and evidence next, as per the 'What happens when' post in the NEWBIES thread post #2.

UKPE had one hearing in Manchester yesterday, Unfortunately I wasn’t able to stay for the hearing due to work commitments, but spoke to the defendant who was very anxious, The defendant is a taxi driver who picked up passengers in 3000 Aviator Way Manchester and was only stopped for a few minutes. The infamous Mr Pickup was representing the claimant and I was with the defendant when he introduced himself. I told the defendant that a brief stop should be covered by the grace period. I asked the defendant to e mail me with the outcome of the hearing, which they said they would do. I have not had a response as yet. The case was due to be heard by DJ Talbot
