Reclaiming money back from various payday loan companies 17th Jul 15 at 9:32 PM
Hi all just wanted to share some good news regarding payday loan companies.....
From early 2011 until mid 2014 I too was caught in the payday loan trap, all my own fault may I add, I borrow the money and in the end paid every penny back, would estimate 15000 over the years maybe 20.
Early this year I saw all the news regarding payday loan companies and irresponsible lending, unfair interest etc etc etc, so I decided to have ago and try and get a few quid back myself.
So far I have been in contact with 5 of the companies I was lending multiple loans from at the same time with many roll overs too, I have received 4 apologies and offers totalling over 5000 and the other complaint is now with the ombudsman.
I never expected these amounts back but if you too were in the same situation, get all your facts in order and get complaining, from the initial email sent I had the money back within 8 weeks.

    Hi All,

Started this process in July, so just popping a timeline on here as may be useful for folks who started a few weeks after me.

Ferratum: raised on 26th July. Final response on 7th Sept. Rejected claim offered £150 good will but refused to alter my credit file. Sent to FOS on 16th Sept. (they have since removed the goodwill gesture)

Wage Day Advance: raised on 26th July. Final response through the post on 15th Sept. Agreed liability on 2 of 8 loans (loans 3 and 8 weirdly) and offered refund of £339.15 but no alteration to credit file. Referred to FOS on 18th Sept

247Moneybox: raised on 26th july. on 20th sept I had a 3 line response back from then (after chasing them with 21 emails and about 10 calls as I did not even have acknowledgement of the complaint) they say they have done nothing wrong, but are prepared to offer £100 good will and removal of negative impact on creditfile. I have written back to them giving 24 hours to agree to all entries removed from my file and a good will of £200 or I will persue with the FOS (Case already raised and allocated a ref number, they are waiting on me to give them the nod) THIS IS BY FAR THE WORST I HAVE DEALT WITH

Fancy a payday (response funding): Just asked on the 28th July could they remove my credit file entries to which they agreed by the first week of august. Only 2 loans and my file is more important to me than any refund.

Payday UK; Raised on 26th July. Final response on 15th Sept rejecting claim. Raised with FOS on 16th Sept

Mr Lender: within a week offered back half interest paid and removal of negative entries on credit file. Accepted

Lending Stream: Raised on 26th July. wholly rejected on 18th August, raised to FOS on 31st August

CapFin (E-cash window/early pay day) raised on 26th July, rejected on 05/09, raised to FOS on 06/09

Payday Express: raised on 26/07, response on 05/09. This is a funny one. 4 rejected, 2 unable to determine and 3 upheld. offered a refund of £586.44 but no update to credit file, which is the critical part. Sent to FOS on 06/09

QuickQuid, sent on July 28th and final response due tomorrow 22nd Sept. (not holding my breath given others stories)

Wonga: raised on 17th Aug, awaiting response due on Oct 12th.

Trusted Quid: Just asked on the 28th July could they remove my credit file entries to which they agreed by the first week of august. Only 1 loansand my file is more important to me than any refund.

MoneyBoat: Just asked on the 20th Sept could they remove my credit file entries and response due by Oct 26th. Only 1 loans and my file is more important to me than any refund.

Uncle Buck raised on Sept 20th and awaiting response by Nov 15th.

I will keep this thread up to date in the hope that it helps others understand the current timeline.
Another point to note is since I started this process in July, my credit score has increased on exquifax from a horrendous 534 to a not so bad 746, so for me, without the refunds this has already been worth while.

Does anyone have any advise on how to deal with the following please?

CashBob (I believe gone into liquidation)
PoundAccess (I believe gone into liquidation)
SpeedyDosh (I believe gone into liquidation)
SwiftSterling (I believe based in Malta)

Hope this was helpful and will keep you posted with the outstanding complaints and FOS progress!

All of my outstanding cases are now with the FOS with case files requested with the exception of QQ which is still working its way through the FOS inbox.

The FOS have advised that its around 4 - 6 weeks for an adjudicator to be allocated, and about 4 weeks after that for an initial findings report.

    Will keep you all posted

Got a reply today from wonga they have rejected my claim which is disheartening, I wonder if it is worth taking to FOS? Will the require bank statements? One of the bank accounts I used has now been closed.

    Winging life....

    Hi there,

My wife was once knee deep in debt with PDL, albeit a few years back now, would she still be able to claim potential interest back? If so, is there a form/template she could use to send out to them?

    Cheers,

Got word back from Ferratum today. Rejected the claim of irresponsible lending however refunded me back £100 goodwill.

My total interest was only about £160.00 and most of the loans weren't actually unaffordable.

Something I never thought id see but happy days.

Just to let you guys know that the ombudsman has reviewed my complaint for 247moneybox and agrees with the adjudicator that they should refund interest on most of my loans. They didn't even bother to respond to the adjudicator so if you are in this position don't give up.

Only Wonga to go now :-)

7 weeks into my complaints with Wonga, WageDayAdvance and Sunny and it's Wonga that have been first to come back with an offer.

They've offered £510 which I'm going to accept, It would probably be upped a bit if I took it to the FOS but it's not worth the months of waiting.

Hopefully Sunny and WDA will follow suit in the next week or so, Wonga was the one I was least hopeful about so it bodes well

I'll update again if/when I hear from them.

    Week 3!

QQ - Asked for bank statements & payslips, I said I didn't have them and have been informed that they "may not be able to fully address your points" without them. So not holding out much hope.

Wonga - Replied saying my details didn't match the ones they had on file (I've married since), confirmed they're looking in to it and will "investigate as quickly as we can".

SafetyNet Credit - Replied instantly saying they will aim to reply within 4 weeks, but in some cases it takes 8 weeks. We will see.

    Thank you
I've been a regular lurker around MSE for a while now but I really wanted to say a huge thankyou to Woody and everyone who has shared information on this thread.
Without this I never would have known I could make a claim. I too was caught in the payday loan trap a few years ago and have really struggled to get myself put straight financially.
Yesterday I received £3k from Wonga which is fees and interest plus stat intererest on three loans and have just had an offer from PDUK of just over £6k. I am absolutely thrilled.
PDUK were extremely unhelpful to begin with and refused to send my information regarding the loans I had with them. I was about to refer them to the FOS as they had breached the 8 week deadline. Taking advice from this thread I mentioned the £550 fee charged by the FOS and they returned with all info and an offer the very next day.
Has anyone received a refund from PDUK? I'm just wondering how long they take to pay?

Was talking to a friend about reclaiming and he was asking how it works if the loan was taken out but wasn't paid back due to him being unable to pay it back?

Bit of a different situation here,

I took a MyJar/Txt loan out on 1st June 2012 for £100 out of desperation

At that time my credit report showed,

£4500 Barclayloan a month in arrears
£5700 Barclayloan a month in arrears
    £37 Overdue payment on Quickquid
    2 Wonga loans showing also

-£311 overdrawn on my current account that only had a £200 overdraft

I've never been able to pay the MyJar back and amount is now £218.

Would this be classed as irresponsible lending even though the loan wasn't paid back?

Further update on mine (8 week deadline 10th October)

Wonga - have confirmed they're paying out in the next 14 working days.

Wage Day Advance - weird email from them today. In my initial complaint I used the 'I only found out I could make this complaint in August 17' line from the DC template as some of my loans are over 6 years old. WDA wanted to know how it was only in Aug 2017 that I made the complaint and not earlier....I asked why this was relevant and they said it was because some of my loans were over 6 years old and therefore 'statute barred' so they needed to know. I've replied to them saying that I was reviewing my finances this year and someone told me I could make a complaint. Not heard back from them since this morning. The emails are from an individual member of staff at WDA and not the generic 'complaints' address so looks like a decision could be imminent.

Sunny - straight up rejection, brief email - 'checks were done at account opening/info we had accounted for defaults on the credit file' etc - totally ignoring that my complaint was about the numerous reloans/rollovers that they authorised. Hilariously the email says that they have just made the decision to not offer any further credit to me - I've been on a reduced payment plan due to hardship with them for 6 months and it's only now that they've decided I'm not further credit worthy?!? If that's not an indication of irresponsible lending I don't know what is....

Sunny have been by far the least helpful and most obstructive, they are the only ones that haven't provided my lending history despite me asking for it 3 times (not even acknowledged).

I've replied to them asking them to actually address the points I've raised and saying I will be going to the FOS.

Expecting and offer from WDA but looks like could be going the distance with Sunny

I've also received an offer from Peachy for the interest on loans ~1&2 with them which amount to £66.67, I have counter offered loans 2,3 & 4 interest which amounts £280.67 so I will see what they come back with
