    I got a parking eye fine when I shopped at 'the range' in shirley southampton. & overstayed by about 20mins? I think. this was at the beginning of the year.(not my fault as tills were playing up).so read up about parking eye & got advice...all said to ignore it..so I did. (Please dont flame me, its what i was told at the time) However..a month or so ago I got court summons papers. So I went to the range with the papers, the notices & my receipt for the day of the fine. I told the shop manager that I have mobility problems (I have to use a crutch & walk slowly leaning on a trolly) that day i was in alot of pain, when I did get to the cash desk to pay, the tills were all playing up..so it took around half an hour to process my purchases & pay. Shop manager told me she would email parking eye telling them I was a genuine customer that day & about the tills etc & get the summons stopped, to leave it with her & she would ring me once she had emailed parking eye, to let me know she had done so. I didnt think I had to do anything after that. ..yesterday I got a court paper saying because they had heard nothing from me that a judgement in favour of parking eye was passed for £165.00. That I now have it on my credit record. I have had a clean credit record for most of my life. I rang the range telling them of this, the lady who delt with it was off, the guy said he would pass all the details on to her when she came in today & get her to ring me. Which I am waiting for now. Also can anyone tell me if the range are the land owner of the site where the range is in Winchester road, southampton. This fine/summons should have been cancelled. But now I have this judgement.Please help.

    Private Parking ticket? check the 2 sticky threads by coupon-mad and crabman in the Parking Tickets, Fines & Parking Board forum for the latest advice or maybe try pepipoo or C.A.G. or legal beagles forums if you need legal advice as well because this parking forum is not about debt collectors or legal matters per se

    Good news and well done, but why do consumers have to put up with this? Trading Standards, CAB, Which, all seemd to be powerless. Someone needs to park an a disabled space, get a ticket and throw the book at them.

    If their tickets are unenforceable, the courts need to start declaring them vexatious litigents.

    If I had a disabled relative now I would have done this like a shot about two years ago! There really is money waiting for people to sue for harassment & discrimination, particularly if threatening to sue big firms like Aldi and the Range (lainieee's case was the Range of course). You just KNOW the big Supermarkets would pay up rather than be taken to court for Equality Act breach.

    Hi everyone, just an update so far..

    Well yesterday 21st January I had the hearing to have the judgement set aside. Judge agreed to set it aside & granted all but one of the ten directions my representative put forward..
    So stage one completed & a massive thanks to my representative from peppipoo \o/ yay my representative also gave me advice on a few other issues I need to deal with. Im so very grateful for the help & advice given to me not only from my representative but also everyone here & elsewhere who have been working behind the scenes so to speak. Thankyou & well done

    Didnt realise how much today had affected me until I passed out after getting home from the dentist at 4pm. Exhausted, aching everywhere but especially painful legs. I was woken around 6.30..& still felt urrghh.

    I've not been around on here due to my father being rushed in to hospital early in December, he had become seriously ill with pneumonia & emphysema, thankfully he has been making a very slow recovey. My laptop has also stopped working & so can only connect via my phone which is also having fits with charging& holding a charge & randomly restarting. New phone needed methinks lol..the laptop I can fix tho

    So, just because im not around alot it doesn't mean nothing is happening...quite the reverse

    This case has always stuck in my mind and others and references to this are always made.

    Lorraine - just caught up with this thread - no doubt the competent pepipoo representative will assist at the hearing - you should be able to put in a counterclaim at the same time - against Parking Eye (though may have to pay a small fee) and then file a separate claim against the Range and CDS.

    Just to keep up to date, we now have a POPLA code, and I was down at The Range today banging on doors, while my clerk was taking photos of the Signage, which I can't read without my glasses!

    I'm trying a new angle of attack outside the court and POPLA, and that is that as PE are losing so many cases on Locis Standi, that is whether they are entitled to take court action, I'm applying to the court to strike PE as the claimant and substitute The range, then potentially get the press involved.     POPLA found that there can be no loss for an overstay in a free car park. Well, whodathoughtit!

    Ironically, Mrs BM has been on the other side for it - nights have been interesting when we were pre-fighting the case in front of my father in law and perfecting our arguments before Hiz'Onner over dinner. As I just said in a different place last night, Mrs BM and I often end up on opposite sides in a fight, and so some interesting Chinese Walls have developed.

    I'm consulting with CouponMad and Lainieenow as to whether we progress to an Equality Act claim against PE and TheRange. Mrs BM says we have a case, and she won't be involved, so she'll help...

    But well done to Lainiee for having the guts to fight, and Couponmad for passing it to me to deal with.
