Son has been told he can't have JSA

Hi,

Since leaving school in late 2006, my son has had a varied number of temp type jobs, and a couple that should have been more long term.
But because he hasn't worked continuously for two years he hasn't paid enough NI. For the majority of the time he worked part-time for halsfords and behind the bar in a club.

He is a qualified level 3 city and guilds mechanic. But he's only worked for a couple of small local garages, then they had to lay him off. So then he worked for ambrosetti - they then layed off staff aswell. he then worked for hyundai at there tilbury dept dealing with the imported car's. They then layed him + others off due to lack of workload. He was then reemployed by ambosetti But due to issues with his transport, and not being able to attend work they then sacked him after 4 months. He hasn't been employed for any longer than 7 months in a full time capacity. He did work part-time for Halfords for 3 years on a 5 hour contract, even though he was working 30+ hours a week (overtime) although not at an overtime rate.
The reason for going into writing is i believe he should be entitled to something from the government, but i don't know what its called. I did speak to someone at the JSA when they wrote to him saying that he wasn't entitled to job seeker allowance, they then said he should fill out a JSA3 form. But i still think its so long winded to get any money its been 10 weeks so far, no end in sight.

  • If he is single he should be entitled to JSA income based.

Income-based JSA should be available to him unless he voluntary left work which it doesn't sound like he did.

I wonder why they don't tell you that you're eligible for JSA income-based when you apply?

It sounds like they have said that he's not entitled to contributions based jobseekers allowance so have asked him to fill out the JSA3 form which is for income based. He should be able to backdate this to when he first applied.

Speak to the people in the Job Centre, they know considerably more then the muppets in the call centre.

The 'muppets' in the call centre have given the OP the correct advice - he needs to complete a JSA3 form.

Why are they all muppets? Would you still call them that if you worked there or knew people who did who did a good job?

You have been given the right advice re JSA3. The people in the call centre are not muppets. They are doing an extremely stressful job, being sworn at, being told that they should die, being blamed for every ill in the world, and trying their best to keep their Customer Service friendly and professional.

I just dont think they've been very helpful, they should have known that he wasn't entitled - if they had bothered to check his file.

It's not perfect, you may not always get helpful person or right advice first time, so you need to check things out at each stage with other sources if necessary.
