Hello all,
I'm an MSE forum newbie...
Thomas Cook flight delayed in November by 17 hours (Tenerife - Manchester). Standard form letters and non-responses from Thomas Cook, so I took them to small claims. They are, of course, claiming technical issue as an extraordinary circumstance.
The preliminary hearing was a week ago, and the Judge told them to file their engineer's report in the next 3 weeks (6 weeks before the hearing), and both of us to file all other evidence and case law 4 weeks before. Date for 2 hour hearing has just been set in early July.
I'm hoping I can rely on Sturgeon and Wallentin-Hermann... but I'll probably be asking if anyone's managed to fight against whatever technical excuse they come up with when I receive it!
£60 down so far and the next court fee is £80... decided to just bite the bullet and hope for the best.
