wage day advance

Hello eveyone:)
My elder and less wise with money sister took a payday loan with a company called wage day advance (not heard of them myself). She couldnt pay them back so they've sold the debt on (now she tells me:mad:). They've been in contact by phone and my sister assured them she is trying to pay it back. She is seeking reassurance that the debt collectors wont turn up at the door step or try taking her property. I told her that they can't although Im not 100% sure but still she is still worried so any reassurnaces any one could provide would be good so I can show her the thread later on. Having children in the house I think shes being anxious. Thanks in advance

If she stays in contact with them and offers some form of payment, it's highly unlikely anyone will visit.
Home visits would typically only happen where they have repeatedly tried and failed to make contact.0 -

They can turn up at her door, but they have no power (particularly not to take her property - only bailiffs can do that after it has been to court, a CCJ granted and not complied with). SHe can write to the company concerned telling them that she revokes their implied right to visit her property and wants all communication in writing (that will also stop the phone calls).
If they ignore her request then she can complain about them breaking OFT guidelines.0 -
Nobody will be turning up (yet). There will be lots of threats of people turning up but any physical action is a very long way off.
Can we jump to the redical assumption she is going to make payments towards this loan?
Trying to pay doesn't actually mean anything.
If she can't deal with it all, get her to talk to Step Change or Payplan who will negotiate with them on her behalf.
If she refuses to make any payments, the debt collectors will eventually come knocking but even then, they will not be bailiffs so they can't take goods.
A CCJ would have been issued prior to that and the Courts will appoint bailiffs to take her curling tongs and smoothie maker.
She MUST make payments, no matter how little to demonstrate she is taking it semi seriously.
Be cautious that they might jump into her account and take the whole lot in her account (she has already given them permission to do so).0 -
In the end, if she ignores it then yes, someone will come a callin.....the fact that they have no powers doesn't stop them and the threat of them turning up being terrifiying............

Just idle threats from bullying debt collection companies threatening all manner of things but will rarely carry them out!
All she can do is make a payment arrangement and only offer what she can afford and stick to that no matter what the collection company say as she wants to make some form of payment.
Also, do not give out bank details, she could open a new account and ONLY transfer the agreed payment into the account for them to debit each week or month.0 -

If debt collectors do turn then thats as far as they can go if your sister doesn't let them in and they cant take her property.
As zx81 says as long as she agrees to some kind of payment plan then the possibility of debt collectors turning up shouldn't happen yet.0
