    "Sorry to hear of your loss. No, because the person who holds the contract is now deceased, the contract is unenforceable. Contact his insurer and advise them of the situation and ask for a refund in full if it was within 14 days. No charge should be made. If it was longer than that, dependent on how he paid, they are allowed to charge a cancellation fee, but will recredit the source of payment for any remaining months. You will need to re-insure to continue using it. It will however show on MIAFTR as having a contract of insurance in place if it was not cancelled, which would cover you on the extension of use on your policy."

    "You would no longer be the main user. So if your spouse used it daily, it would be breaching the terms and conditions of the policy. If you insured her as the main driver, then you would be fine.This would mean a fresh policy. If you wanted to continue to use your policy, she would really need to have access to her own car and be the main user of that, to be a secondary user of yours."

    "Your insurance is technically void as you no longer have a license to drive. It's contractual that you do, though it does fall into a grey area. The contract of insurance is covering the vehicle as well as you, and it may have been a policy covering more than one person. Plus the need by law for a vehicle to be permanently insured if it is on the road. This being the case, you would not be breaching the terms and conditions of the contract, as you would not be driving, so your own insurance would not cover you. But the vehicle would have a policy on it, satisfying the minimum road risk element of the Road Traffic Act. This would then mean that someone could use your car on their own insurance policy.

    There's a case, called Kelly V Cornhill Insurance Company, where the policyholder died, but gave permission to his son to use the car on his policy prior to death. It was found the ontract of insurance was still in place even though the "contractee" was no longer party to the contract. Based on this, the answer would be yes. The easiest way of finding out is by asking your insurer directly."

    I stated on a comparison website that I am a resident in the UK from birth, when in fact I've only lived in the UK since 02010. The insurer asked for some documents shortly after the policy was taken out. Later they called to tell me that they think I misrepresented myself deliberately to get cheaper insurance.     "Yes, you can raise a complaint with them and then escalate to the financial ombudsman. Requote yourself again via the same website and same insurer, this time ticking the right box, and see if they are willing to provide cover. If they do, do a screen print as evidence and save it. This shows they should not have voided the policy, but amended and charged you extra. The only time a policy can be cancelled is when it's fraudulent or wilful misrepresentation, where the insurer would not have provided cover had it have known otherwise. If you can prove they would have, then they will have to reinstate the policy whilst ensuring you are not negatively affected in any way."

    Bearing in mind IG incorrectly quotes the Consumer Insurance Act in cases that are entirely irrelevant, you would think he would understand how it works on a case it actually covers...

    "They operate on a block policy, i.e. covers any person for any risk whilst using their vehicles - rather than insuring the one person. If you hire out 20,000 cars a year for the whole year, and 200,000 people drive them, the risk is spread over the 200,000 people. Out of that, only 1000 may be American, you have a one in 200 x 365 days x 20,000 = 1.4609 million to one chance of claim (in principle). Compare this to an extremely high probability in comparison of one American driving in the UK on your policy, or their own policy on your car. There's no one to split the risk with. The probability of a foreigner with no knowledge of our highway code, road system, driving a right hand drive car on the left hand side of the road for the first time creates a high probability of risk."

    I contacted my insurers to inquire about getting some vandalism repaired on my Range Rover, but it turned out the excess on my policy (which also has protected NCB) was more than the cost of repairs so I did not proceed with the claim. Now I find the insurers are telling other companies who inquire that I have a claim against my policy. Are they allowed to do this? My daughter just passed her test and insured her first car adding me as a named driver - her insurers then added £120 to her premium because my insurers told them I had this "claim". Is there anything I can do to get them to stop this?"

    "In short, no. Your insurer cannot penalise you for enquiring about a claim. Contact your insurer and raise a complaint. Demand they take these details off CUE, the underwriting database. Someone has logged a claim when they should not have done. Contact the financial ombudsman service and raise a complaint with them as well, should the insurer not resolve your situation to your satisfaction."

    "Someone hit my car with a shopping trolley - are they liable for the damage?
    Someone let his shopping trolley run free, which hit my tailgate causing £500 worth of damage. A witness saw what happened and took note of his car reg as he drove off. I've asked the DVLA for his details as well as the police and insurance company, but no one will supply me with any information so that I can take him to a civil court. Can you help?"

    "You're unfortunately stuck. As this wasn't a collision involving a vehicle, you have no entitlement to his name, address or insurer. It's a civil matter where he has caused damage to your property, rather than the use of his car too. What you can do is try and claim off the supermarket, as they may be liable whilst your vehicle was on their premises. It would then lie with them to try and trace the owner. But I think you'll probably be flogging a dead horse."

    "I was involved in a no fault, multi-car crash - why has my insurance premium increased?
    I was stationary in traffic a few months ago when I was hit from behind and shunted into the car in front. The person in front said there was only one bump and the person in the car behind me admitted responsibility for the incident. It should have been no problem - my car was written off, the money was paid and I got a replacement car. Due to an increase on my premium, I changed insurance and had to pay a cancellation charge. The insurance company took the remainder of the year's premium, saying that because the case was still open, they would refund me once they had confirmation it was closed. I have now found out they have put my claim down as a fault claim. My insurance don't seem to care (I guess it makes no difference to them), but having a fault claim and a no fault claim makes a big difference to me. In hindsight I wish I had called the police and gone down that route. Any advice would be appreciated."

    Insurance Guru answer...

    "Contact your insurer and ask to speak to their third party liability section and ask to speak to a manager. Advise that you do not accept liability in any way and the person who hit you forced you into the vehicle in front. Advise that you wish for them to claim any increase in premium from the at fault party and tell them you wish for your no claims to be reinstated. Your insurer should not have retained what was left of the premium as you are not benefiting from the cover that is still left. If you've changed insurer, they need to reimburse you. Contact the Financial Ombudsman Service and raise a complaint as well."

    "Depends on what the trade is. The vehicle on the trade policy needs to be in use as part of the course of its business, so if it's a sales vehicle - the answer is no. If you're lending a vehicle that is in general use, like a van, yes. This is because it would only cover them to drive in connection with their business. The vehicle has to be on the Motor Insurers database for you to use it on an extension of use through your policy. Check on there. If it is on, then you can. If it isn't, you cannot."

    "Somebody insured vehicle in my name - how do I prevent this happening again?
    A debt recovery company sent a letter to me, which claimed that I owed them money on a Hastings policy. After I contacted Hastings, it transpired that I was the policyholder of an unknown vehicle with another person as a named driver. I was dealt with by the fraud department at Hastings and was advised to contact Action Fraud too. Their telephone line directs you to their website for some form filing and cuts off. It felt like just a form filing exercise and would no doubt at best be buried amongst the stats. Is there any way I can be more proactive and prevent possible further cases?"

    Insurance Guru's answer...

    "Yes, raise a complaint with Hastings and ask them how someone has managed to create a policy that provided payment details that don't match yours. You always have to make at least one payment to create a policy, my concern would be why they did not pick this up at the inception of the policy. Ask Hastings what action they are taking against the named driver. Also complain to the financial ombudsman service. They should also be able to get the registered keeper details from the car."

    What made me raise my eyebrow even higher was that they actually published the questioners full name (I assume it's not an AKA etc) after their question (I have omitted it from this post)

    Is this the case here i wonder?

    Our insurance company says we have to make claim on our insurance after a minor knock? Is this right?
    Our motorhome knocked wing mirrors with a much larger motorhome in France. We filled in the Constat Amiable D'Accident Automobile (which we had a copy of in English) and agreed as well as we could with the language barrier that it was knock for knock or 50-50. We have replaced our mirror at a cost much less than the insurance excess. However, our insurance company has now been in touch saying that we have to make a claim and that the costs are put together and split between the insurance companies. We would prefer not to make a claim as no doubt our premiums will go up. We thought in the case of a knock for knock or 50-50 each insurer paid it’s own customer. Do we have to

    Hi Linda, it depends on whether the other party have made a claim on their insurance or not. If they have not, then no you do not. If they have, they you will have too. Contact your insurer and ask if they have had any communication with the other parties insurance company, ask for proof of third party outlay and confirmation of their excess. If both your claim for damages and their claim for damages is less than each respective parties excess applicable, both parties can cancel the claim. It Should then go as "for notification purpose only".

    "My friend, a named driver on my car, had an accident while driving abroad - why does my insurer now say he's not covered?
    I added my friend to my policy when we were going on holiday to Italy together. Unfortunately, he had an accident in the car and now my insurer says he wasn't covered and that the named drivers are only insured in the UK. My insurer has never made me aware of any geographic limitations for drivers named on my policy - how can they get away with this 'post-accident' limitation? My insurer says I should have told them I was adding my friend for a holiday, but why would I? I wouldn't phone my insurer and say 'I want to add a friend for Tuesday, and he might be out in the rush hour, and maybe cross the border into Leicestershire.'"

    Insurance Guru's answer

    "Unless you ask the specific question, then your insurer is correct. It's your duty not theirs to make sure the cover you have is what you require. Never presume anything with insurers, they will take any opportunity afforded not pay. You need to make sure they cannot do this prior to any incident. This situation is of your own doing because your presumed rather than checked. Going out on Tuesday in rush hour, over a border to Leicestershire, is hardly like going to a different continent. Did you read your policy thoroughly prior to going abroad? There might be ways around this to make the insurer pay - but I would have read the full policy and listen to all the recorded phone calls from when you took the policy out, to when the claim was made."
