I Need Help regards To Morgan Stanley Pls

As you all know Ive started my dmp today. Well I thought today would be a good day because of this but no i was wrong.
Ive just got off the phone from a horrible evil women at Morgan Stanley who said that regardless of me writing to them advising them of the cccs's involvment and me requesting all corres to be in writing, they do not have to do this. As far as theya re concerned they will keep calling as my payments are behind and as the debt is mine its up to me to sort this and not the cccs. I told her that I had seeked advice and if they continued to call me it would be classed as harrassment (sp?) but she said that the advice i had got was wrong and they would and could continue to phone me and if i wanted i could record the calls.
They are yet to hear from the cccs (she says) how long does it normally take for them to get in touch with my creditors?
This women wouldnt even let me speak, continually interupted me - !!!!!!
Im so upset about this, i thought things would start to get better and now this.
Sorry to moan, i just dont have anywhere else to go with this.

why not send them a copy of this letter (recorded delivery) and explain that further to the very abrupt phone call you recieved today you feel you have no choice but to get them to now comply fully with the letter.
Dear Sir,
Ref. XXXXX
Despite my letters regarding ANY communication from your company, which stated that I require ALL communications in writing, your telephone calls continue.
This behaviour constitutes harassment; the letters stated quite clearly to you that I require ALL communications in writing for future Court use. Do not telephone me again - remove any telephone numbers you hold for me from your systems.
Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to your local Trading Standards office. For your information note that ALL telephone calls are taped.
Take further note that continued telephone calls after the receipt of a request not to call constitutes a criminal offence under Section 127 of the Communications Act 2003.
COMMUNICATE IN WRITING – THIS MEANS NO TELEPHONE CALLS, THEY WILL NOT BE ANSWERED, YOUR ‘OPERATIVES’ WILL NOT BE SPOKEN TO.
HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

Hi Pixie...............we seem to have a lot in common..........lol.
I had the same problem with Morgan Stanley last year..........the continually 'harrassed' me until I agreed to pay an agreed sum way over what I could afford. The woman on the phone was obnoxious and wouldn't listen to anything I was saying. I really lost it with her on the phone....... At the moment I am ignoring all phone calls ( I have sent them a letter telling them I am arranging a DMP)....but I am expecting a default notice - they are one of the worst companies I have had to deal with.......they are a set of baskets!!!!.
I would go with Crystals letter...........I am going to use it!!!

Hi Pixie I've had nothing but trouble with this lot too :mad: Still trying to get a refund of £288 they owe me!! They won't even speak to me on the phone now as I have put in an official complaint :rotfl: Keep your chin up hun try Crystals letter and do seek further advice from cccs and see what they say we're all here for you :grouphug:0

Hi Pixie, they are awful, I am having harrassment from them too. I am going to change my tel number. That should stop them. If you don't want to do that then just call BT or whoever you are with and ask them to bar all witheld numbers. All these call centres have witheld numbers so they can't get through. they get a message saying the number they have called does not accept witheld numbers, please hang up and try again without witholding your number. This should frustrate them and leave you free to continue your dmp.
As far as I am aware if they take you to court the court will uphold your dmp so you don't need to worry.

Thanks everyone for your kind words and advice. Im going to send that letter tomorrow but i dont hold out much hope as she said that they could continue to call regardless of my request. But at least I will feel as if Im doing something.

Aww hun, send the letter and if they don't stop harrassing you refer it onto the fair tradings office etc. It's not as if you're attempting to pay them zilch or irgnore the debt you've faced up to it and just remember you do not have to talk to them if they ring again politely and firmly say I have asked you not to contact me via the phone then hang up.0

I too had trouble with Morgan Stanley, and in the end I told family and friends that when the answer phone kicks in - leave a message as I did not intend to answer the phone until I heard the message machine.
Once I knew it was my Dad, or friends etc, then I picked up - anyone else could leave me a message.

just read your comments on being harassed and as another member has advised harassment is illegal i have pasted below an excerpt from section 40 of the Administration of justice act you can easily find this by searching on the web for s40 administration of justice act .
SECTION 40 OF THE ADMINISTRATION OF JUSTICE ACT
“S40 Punishment for unlawful harassment of debtors.
(1) A person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under a contract he-
harasses the other with demands for payment which, in respect of their frequency, or the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation;
falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it;
falsely represents himself to be authorised in some official capacity to claim or enforce payment; or
utters a document falsely represented by him to have some official character, or purporting to have some official character which he know it has not.
