Whiplash Claim

I was involved in a motorway accident, luckily i walked away from the crash with what seemed to just be shock however the next day i was in complete agony with my neck/shoulder/back/jaw so i ended up in a&e and diagnosed with whiplash.

For the first 4 weeks after the accident i was prescribed diazapam and coedine to assist with the pain/sleeping and then on a routine dental appointment my dentist noticed my jaw veers off to the left (explaining the jaw pain since the accident) Due to this severe pain i have been left unable to eat solid foods and have lost over a stone in weight (i am only slim to start with)

It was never my intention to make a claim fr compensation however whilst looking into physio for my whiplash i was advised to speak to a solicitor. The solicitor arranged a medical for me who concluded that i did indeed have whiplash which he would expect to take 6 months to recover and he referred me for a physchological examination which suggested that i have moderate depression and anxiety caused by the accident so i am being reffered to a psychologist. I am still awaiting an appointment at the facial unit at the hospital to find out exactly what the problem is with my jaw and i have 6 physio sessions left out of what was suggested it would take to aid my injuries.

My question is how long does the whole process take and does anybody have an estimated figure of compensation i may be entiteld to?

    As long as it takes for everyon to finish arguing and getting paperwork in order (could be weeks or years). Vaguely remember the standard payout for whiplash being about £750.

    I'd tell them some nasty words if they directed me to psychologist because i had a car accident :mad::mad::mad::mad::mad: money grabbing carp bags! :mad::mad:

    I have been referred to a psychologist because of the anxiety I now suffer when in a car. I haven't been able to drive since the accident, the two occasions I have tried to I have ended up having to leave my car by the side of the road and have someone else pick it up for me because I'm too much of a nervous wreck to drive

    OH was in a serious car accident 3 months ago and has been left with a brain injury, speech issues, busted shoulder, whiplash and mobility issues.

    He has started speech therapy and we are waiting on other referrals currently we are yet to receive a penny despite several requests for lost of earnings and other outlays including prescriptions (over £200 now). My insurance company have issued court proceedings to get an interim payment of £15K to cover lose of earnings so far and private medical rehabilitation we have been advised this could take a further 2-3 months

    However when one of my exes had a straight forward whiplash claim it was dealt with within about 6 weeks and he got £3.5k and he had only had 2 days off because of it.

    There are no hard and fast rules on how much you will get I'm afraid neither is there timescales as we are finding to our great annoyance.

    Just concentrate on getting better as best you can and take any help they offer you and I hope you get better soon

    That's terrible faith, I can only imagine what you and your partner are going through at the minute. The prescription charges have also been a nightmare for myself too, the painkillers that I am on at the moment you can't buy over the counter and the ones that you can don't cut the pain so i estimate it has cost me around the same!

    I can't believe they haven't paid you a penny out up to now that's ridiculous! I'm grateful my injuries aren't that bad however luckily I have managed to get the treatment I need privately (paid by insurance) other than the maxofacial surgeon which is nhs hence why my appointment isn't until July so I dread to think how much more weight I will have lost by then.

    I wish you all the best of luck and I wish your partner a speedy recovery and that he gets what he is entitled to

    Glad you're at least getting some treatment that's the main thing at this point in time. We are waiting for authorisation on funds to start private rehabilitation but no luck yet. NHS waiting is a nightmare we have been waiting for a neurologist appointment for ages he finally has one next week which is 10 weeks since he was discharged from the hospital

    I can sympathise with the other the counter pain killers. OH is on some seriously strong ones because the normal pain killers do nothing it's like waving a tissue at a flood

    Just seen your thread & thought I'll tell you what I can about my claim.


    Back in December I had a lorry drive into the back of my car whilst stationary on the M25 (waiting to get onto sliproad). I felt ok and my car held up well and took brunt of the damage. I took myself to hospital to get checked over as my back was giving me grief but they sent me off with painkillers. The next day my doctor diagnosed me with whiplash of my lower back as it was absolute agony.


    Now it was my car insurance who referred me to make a claim (they clearly get a referral bonus), so I thought why not...at the time it never entered my mind! I was more worried about my little girl as I couldn't lift her and silly little things that suddenly hurt to do!


    So now, after about 6-8 weeks of physio, and a psychologist assessment (same as you, I had shocking panic attacks especially if a lorry was behind me), my solicitor is putting a claim to the third party for £5,600. I was told that my physical injuries would last 4&half months and mental for 10 months....that's how they based my claim. Although I do still hold my breath if a lorry pulls up behind me in a car and I still get niggles in my back now. I could have gone on to an orthopaedic surgeon to assess my back further but that sounded a bit drastic personally for a few niggles so decided against it. Plus I just want this all over and done with now.


    In fairness I personally would say you should get more than that but I assume it depends on the solicitor and the third party's response. And with regards to timescale, if you are seen quick enough by the professionals and the reports are compiled quick enough it will take a few months....apparently mine is pretty quick and this is now 6 months later!

    I had a straight-forward whiplash claim and got £1800.


    The whole process (Mostly waiting and 1 examination by an independant doctor) took around 9 months.


    It sounds like you will be due much more than me though, and the process may well take longer. especially if you still arent healed yet, as the lenght of time to heal prognosis goes a long way to deciding the renumeration you will get.

    I am still no further on with the claim and it has been nearly 7 months now. I have had a couple of NHS appointments with a maxillofacial surgen who has diagnosed me with TMD and i have had a dental splint made that i wear at night to try and correct it and now i am awaiting an appointment with the maxillofacial surgen specialist appointed by the solicitor in order to write up a report.

    I am still suffering with terrible travel anxiety and have been prescribed antidepressants/anxiety tablets, i had 6 hours talking therapy with a specialist appointed by my solicitor who has wrote a report suggesting i will suffer with the mental symptoms for 6 months (i assume from no) as it is already 6 months since the accident. It has been one long process and i just want it to be over with now.
