    What is the exact wording in the Avis Ts & Cs which relates to parking tickets and to admin fee?

    Car hire/leasing contract terms & conditions usually have a clause about the driver being responsible for fines or penalties. That means legally enforceable fines or penalties from councils, police, train operators and Transport for London.

    But this is a speculative invoice from a private company.

    If they want to pay it, advise them as above. If they’ve paid it, that's their problem. If they’ve taken the money from your account, ask for it back, or else you’ll sue them for breach of their own contract.

    What business is it of theirs, this is your fake PCN to ignore and OF COURSE you must not pay it.

    But you must also demand a refund from Avis and make it clear that no other 'admin fees' over a fake PCN will be paid. And advise your card company that your business with Avis is finished and that there is no longer a standing authorisation for Avis to take money from your card. Do that NOW, up front, to stop Avis being daft or devious enough to try to take £30 every time the PPC try another threatogram.

    Avis need to know that this was NEVER a fine, not their liability, not their business and not their excuse to charge you £30 as if it was a real PCN. Use emails exactly like that poster. You n eed to be very clear and very assertive now with Avis. This is not on! Check the t&cs of hire, post them here if unsure if they cover them to debit this £30 for an invoice to a person over an alleged contract issue.

    Just because a piece of paper is dressed up to impersonate a parking ticket doesn't make it so.

  • Thanks so much for your quick responses. I had drafted a letter to Parking Eye, so that I could try to get this letter excusing me from the charge to send to Avis. But it seems like I should write to Avis in a similar way to the Sixt case.

    Here's the term and condition relating to the parking charge. Let me know your thoughts...

    (d) On demand, all fines and court costs for parking, traffic or other offences (including any costs which arise if the vehicle is clamped). Renter must pay the appropriate authority any fines and costs. If he does not, Renter will be responsible to pay Avis’ reasonable administration charges which arise when Avis deals with these matters.

    Just off to bed now but none of that paragraph relates at all to a private allegation of breach of contract against an individual driver (which = a fake PCN).

    Any alleged breach which results in a fake PCN is not an 'offence'.

    A PPC is not an 'Authority' (Council or Police or Train Operator would be).

    A fake PCN is not a fine.

    Avis has no business to deal with the matter. It's not theirs despite the arrival of a letter from a PPC or debt collector. Avis should follow the industry advice from the Lease company Trade Body, the BVRLA, as already linked above by Stephen Leak.

    There is no point writing to parking eye, they won't send you anything about you not paying, you appear to think you are dealing with an ethical company, you are not ! They will in fact write to Avis even more if you contact them as they are soft target.

    As for Avis and looking at the terms above they have breached their T&Cs as this is not a penalty/fine and parking eye are not an authority. Don't ask for your money back demand it, inform that if you don't get a refund you will issue proceedings against them. They are in the wrong it's that simple.

    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?
  • I am copying the e-mail style from the Sixt case now. I thought I should post the e-mail from Avis from about a month ago after I e-mailed them following a phone conversation.

    Please note, I also received a PCN charge which I am currently arguing out with Islington council for the famous Riversdale Road N5 area. So I actually received two letters and two lots of £30 admin charge. If I end up having to pay the PCN charge, I can live with that because I argued it out and it's Islington council. The £30 admin fee does suck.

    However, the Morrisons car park admin fee with Parking Eye, I understand as you're advising, should be refundable now!?

    Dear Madame,

    Thank you for contacting Avis.

    Further to our earlier conversation you can find the penalty charge notices in the attachment.

    In case a penalty occurs during a rental the local authorities contact us as the registered owner of the vehicle. We transfer the liability to the driver and forward the contact details to the local authorities as we are required by law. We also charge an administration fee of £25.00 plus VAT per penalty for the time and labour involved.

    The local authorities will then contact our customers to settle the further payment. Unfortunately Avis is not in the position of influencing the local authorities' speed in contacting our customers.

    I hope the above explanation is of help in clarifying this issue. Thank you for your patience while this case was investigated.

    The council ticket is a completely different thing, and their admin charge is steep but you'll have a hell of a job getting any of that back as its in their terms . I can tell you as the RK is liable for that they will probably pay it and bill you, I have never heard of a hire company who lets you appeal a council pcn before.
