Have you tried PHONING ebay and seeing if they will intervene? You MIGHT just get someone with some common sense...
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

What are my chances if I wait for the item to come back and then dispute the case outcome on the basis that the buyer lied and the item was as described?
    Somewhere less than zero.

eBay will say that you have your item back and that you can always re-list it.

Hi sorry for hi jacking another persons thread but would appreciate some advice myself, I know soolin in an expert in these things, I sold a kindle in working order, I had won it in a competition and hadn't used it , so I charged it before selling and all was fine, 36 days later the buyer has said it won't charge for him and wishes to return, ebay have said it's too late for their rules but paypal have frozen the value of the transaction , what's the probability of the buyer getting a refund from my PayPal account without eBay

They wont just do that, the buyer would have opened a case which will be under escalations in your PP account, you need to read that and respond. If you dont then yes the buyer will win and the money will be taken from your PP account

Thanks for reply, I called ebay and they have said as it over the 30 days he has left it too late for a refund, which he is aware of, but when I go into paypal it just says to log into my ebay to resolve, so will paypal overrule ebay and refund anyway.

I agree, I would give PayPal a call and don't let this slide.
