How can a company sell sick notes?

    Companies do not need to work to the same standard of evidence as a court of law. If the certificate looked obviously altered and the employee couldn't prove it hadn't been, such as by authorising the surgery to confirm the details, that would probably be enough to justify dismissal.

    Would it breach data protection for the company to send a copy of the certificate back to the doctor with a simple yes no question of if it and the date are exactly as issued?

  • Bath cube, as others have said, dismissals for gross misconduct does not require level of proof similar to that in criminal court. So in theory, yes, they can. It will be extremely expensive to challenge them (e.g. get forensic experts on handwriting to prove that he did not alter the sick note), such that it may wipe out the compensation even if you win a tribunal case.

    You need to cover your !!!! in this world. How about sending a scanned copy or photograph of the sick note as well as the original paper copy?

    Of course, if the company wants to get rid of you, they will find a legal way to do so. Don't forget that many large companies have teams of lawyers in their HR departments - specialising in things like this!
  • To answer the original question, yes I'm sure you can get pretty much anything "off the internet".. including fake ID etc.

    (And no I don't know which sites they are! Just saying it's a piece of p*ss to fake documentation these days, and a lot of people do)

    You may have also missed the one where the guy went into the disabled toilets only to walk in on a guy sitting on the toilet watching p0rn on his laptop and sweating for some reason.

    OP proceeded to tell the first person his saw and it spread like wildfire, OP was then wondering if he was going to lose his job...........
  • All I can say is nonsense to some replies. Just say is another employee at our company was accused of doing this. I'm sure it would be seen as more than just a coincidence. If it happened to me I would certainly fight my corner.
