Middle name is wrong on will. How will this effect probate ?

Hi all,

My friend has applied for probate for someone in her family. She has noted that the will has used the wrong middle name; however the family member has used the correct middle name when signing the will and used the correct middle name when printing the name under the signature.

Does anyone please know whether this will effect her probate application ?

    She needs to ask the Probate Office


    Best case - it will make no difference


    Worst case the will is invalid and the rules of intestacy kick in - or an earlier will if there was one


    Very worst case - either of the above but after a long and expensive legal case

    Ask the probate office for advice - it is possible the witnesses to the will could be asked to swear an oath that the person who signed the will in their presence was actually xxxxx

    When the death was registered, was the correct name included on the death certificates ?

    Yes the correct name was used.
