    I was told when I asked ATOS before one of my ESA assessments that someone can come with you but will not be allowed to participate in the assessment. Hence why my wife always sat outside in the waiting area.
    They can participate but usually the HCP will want the answers from the horse's mouth so to speak... but that may not always be possible.

    When I said directly to my husband I meant about what he does for me ie dealing with my medication, cooking, escorting me places. But there were some points when he just stepped in and spoke directly to assessor simply because I couldn't I found the whole process awful, but in saying that It is because of the reasons why I am suffering the disorders that I am, I do not want to put other people off. I just don't believe that I could put myself through that again.

    Well received the ATOS report today (no decision yet) in fairness I have to say it was quite an accurate report and said that I was flushed sweating and wringing hands/pinching myself. The only thing I didn't agree with was minor that "I didn't look tired" I felt this was a little unfair as this was the first time I had met this person and not sure that they can fairly judge that.However looking at the descriptors and scores looks like I have scored 7 got daily living and 4 for mobility so there is a chance that "computer says no!"

    Oh dear those points don't sound too good for your award. Although nothing is final until the DM makes a decision. You may want to start thinking about whether you're going to ask for the Mandatory Reconsideration (MR) but you said above that the report was quite accurate.

    Yes, I have already thought that what confused me was that the assessor suggested a review in 2 years? I don't know whether that is standard on these reports as just a gauge for the DM.

    Yes they usually suggest a review date. What they mean buy this that they're saying your condition will remain the same for that length of time. They will do the same for those that don't get any award. Hopefully for you the DM will go against the report and you'll get that 1 extra point for an award. They don't often go against the report but it can happen. Good luck.

    Just a question to clarify for the OP.
    If you don't get an award but give a review date of two years - does that mean that if you put in a new claim before the two year period is up they will automatically refuse it on those grounds?

    Highly possible yes because in there opinion your condition will remain the same for that length of time.

    As far as I know there is nothing to stop a claimant putting in a fresh claim once theirs is turned down. For example if someone filled in their form without help and scored 0 points, is there anything to stop them getting proper help eg from CAB or Welfare Rights to make a fresh claim, rather than go for a MR.?

    Nothing stopping you putting in a new claim if you're refused first time, but what's the point? They could very easily think because you've only just be refused and refuse you again without an assessment. May as well go for the MR then Appeal Tribunal at least this way you'll get back dated money from the day you applied (unless transfering from DLA of course)
