I'm not sure if this will work, but it's called Park Avenue, and if the link does work, my car was basically where the red car was when it got photographed.

One to check with the local council as to whether that part of Park Avenue is private land or public highway.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

There were no signs saying it was private land. It's a reasonable assumption for me to make that it's a normal road, isn't it?
They have since installed a big post with PCM on it, basically just next to that red car.
I used to park there every day, and go into the building behind. I have actually looked around a bit further on Google Maps, and just further down the road a bit, where the corner is in front of the red car, there is a PCM sign, but it's kind of around the corner, and I never walked that way so had never seen it.0 -
if you follow that road there are lots of PCM signs , and road signs/markings that cannot be council installed , also google street view keeps showing me "X" as if its not a "proper" road

To be honest, now I've followed the road all the way around on Street View, there are a few PCM signs, but I only ever parked where that red car is, and walk into the building, so during that walk, I never saw a PCM sign, and as no other car had a parking permit, or anything like that, and there were no double yellows, I didn't think to actively seek out a parking sign.0

I'll ignore the Debt Recovery letters and wait to see if PCM get back in touch with any sort of court letter, and then I'll post again for advice.0

I looked up PCM and they are on the ICP website, so I followed the newbie thread advice, and appealed using the template, asking them a number of questions including who the landowner was. I was going to write them to ask them to cancel it.
However, PCM have come back to me to say they cannot release that information, or any details of contracts with landowners as it is commercially sensitive.
What should I do now?0 -

So, just so I'm super clear (sorry to be dim), but I sent them this appeal:Dear {name of IPC member, only IPC members for this version!!!}
Re PCN number:
I am not ignoring your charge for a purported parking infraction. As this is purely a charge (not a statutory penalty) issued under a purported contract and the driver has not been identified, I require the following information so that I can make an informed decision:
1. Who is the party that contracted with your company for the provision of their services? I require their contact details.
2. What is the full legal identity of the landowner?
3. As you are not the landowner please provide a contemporaneous and unredacted copy of your contract with the landholder that demonstrate that you have their authority to both issue parking charges and litigate in your own name.
4. Is your charge based on damages for breach of contract? Answer yes or no.
5. If the charge is based on damages for breach of contract please provide your justification of this sum.
6. Is your charge based on a contractually agreed sum for the provision of parking? Answer yes or no.
7. If the charge is based on a contractually agreed sum for the provision of parking please provide a valid VAT invoice for this 'service'.
8. Please provide a copy of the signs that purportedly were on site which you contend formed a contract with the driver on that occasion.
If you believe you have a cause of action, send a Letter before Claim within the next 21 days and I will take advice and will respond.
In my opinion, there is a better alternative than legal proceedings, namely that we utilise the services of a completely independent ADR service suited to parking charges. This does not include the IAS appeal service - which lacks any transparency and possibly any independence from the IPC - unlike the alternative offered by the British Parking Association, POPLA, which is transparent and has been shown to be independent.
Do not send debt collector letters and do not add any costs or surcharges. I will not respond to those, so to involve another firm would be a failure to mitigate your alleged loss. In any case, the addition of any debt collector 'costs' is not my liability because the POFA 2012 can only potentially hold a registered keeper liable if certain provisions have been met and even then, the 'amount of the parking charge' is the only amount pursuable.

as per the advice, and they've emailed back to say "we're not releasing that information", and now I should just totally ignore them, and ignore any further debt recovery ltd letters, until I get a court letter.
When I get the court letter, I should post back here for advice.
Is that the best plan?
