Hi The judgement against my husband was on Friday, we could no pay the full amount so waiting to hear from the court as to the outcome. In the meantime Reston has sent us an expenditure form to fill in. If this case is being dealt with through the court do we have to deal with Reston directly?

Fatbelly may be able to best advise you on this.

Did you provide the court with your income/expenditure ?

They may want family income to best judge your situation.

Do I have to give them? When we went to court I wasn't even allowed to speak because the debt wasn't mine!

At this point, it's best to fill in the I&E.

They already have a charging order, and they clearly believe that you're short changing them.

At £5 a month, it'll take 31 years to pay off £1900, so this is likely why they pushed a charging order through. If your I&E shows that's all you can pay, they wont be able to do anything, but I don't know if anything can be done about the charging order now.

That's something you'll need legal advice for and I'd advise going to the CAB with all the details. Again as above if the house in in joint names, it'll be a restriction, not a charging order which means it isn't automatically actioned on a house sale anyway, another reason to see the CAB to find out exactly what's up.
