Getting Daughters Tax Rebate

My daughter left school last year age 16. She applied for and started a hairdressers apprenticship in September. Prior to that she had a part time job to tied her over before she started at the hairdressers.
While at her part time job she was put on emergency tax, even though she only earnt £40 per week. When she left there, she took her P45 to the hairdressers. The hairdressers accountant 'lost' her P45 but didn't notify her so she still paid emergency tax on her next pay day. She filled in a P46 but they still deducted emergency tax.
She didn't get one with the people at the hairdressers and was 'advised' by the manager that she would be better off at college to learn hairdressing. So on their advise she voluntary left her job in January [4 weeks ago]. On her last wage slip she did not pay any tax, her tax code was altered, but she still did not get any refund.
She has since telephoned the tax office and was told that the hairdressers accountant should have sorted it out [we know that] and that she could not claim the tax back unless she either signed on for Job Seekers Allowance or got a job.
She has been relentlessly looking for work since. She went to the Job Centre and was told that she was unable to 'sign on' until she was 18 !!
She desperately needs this money back from the Tax man. Bus fares into town to look for work and bus/train fares to interviews have taken all her last pay packet and its now beginning to eat into my wage. I can't not let her have bus fare money can I?
How can she get back the money she is owed?

You need form R40 from HMRC website
