Information on how to enter forms part of these conditions of entry. Participation in this promotion constitutes acceptance of these conditions of entry.
Entry is open only to United Kingdom and Republic Of Ireland residents aged 18 and over. Directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or the agencies or companies associated with this promotion are ineligible to enter. No purchase necessary for Northern Ireland residents (see clause 6).
The Promotion is open between 00.01 on 4th March 2013 ("Opening Date") and 23.59 on 31st August 2013 ("Closing Date"). All claims must be received by this date.
To Enter: Purchase a promotional pack of either Dairylea Portions Regular 280g or 140g; Dairylea Jumbo Dunkers 188g; Dairylea Ritz Dunkers 184g, Dairylea Spreadable 160g or 300g Tubs, Dairylea Spreadable Light 160g Tub by the Closing Date. Purchase is necessary (excluding NI).
There are two elements to the promotion:
INSTANT HOLIDAY WIN ("Instant Win Packs"): There are 10 Holiday Prizes to be found in this tier. All 10 Winning Packs will contain a special moo gadget, the gadget will make a 'moo' sound when the sensor is activated, which shall sit in the place of the product inside the pack. The winning packs will also contain instructions of what the winner will need to do in order to claim their prize. Please follow the instructions and call the number shown on the sticker on the gadget inside your mooing pack in order to claim your prize.

Please note: You will be required to specify; the unique code found on the gadget, the Dairylea product you bought and where you bought it. You will also be required to send in your winning pack via Recorded Delivery to an address that will be given to you when you call to claim your prize. The Promoter will reimburse you for postage costs. If you are unable to provide this information in full then it may affect your prize claim. You may be required to provide the original till receipt dated within the promotional period showing your Dairylea purchase as verification. You will also need to provide your name, telephone number, postal address, and email address. We will collect these details in order to arrange your holiday and send you a coupon for money off your next purchase of a Dairylea product. The coupon may be used in part or full payment for any Dairylea product up to the value of £2.00 until 30th June 2014. We recommend you make a photocopy of your original pack/till receipt for your reference.
ONLINE INSTANT WIN ("Unique Code Online Entry"): There are up to 20,000 mooing cows to be won in this tier. Every Promotional Pack of Dairylea has a 7 or 10 digit unique code found inside the pack ("Unique Code")which shall enable the entrant to check if they have won a Mooing Cow. To enter you will need to visit: https://www.dairylea.co.uk or https://www.facebook.com/dairylea and click on the "Dairylea Moo Promotion" tab. In this tier, you can enter your unique code to find out if you are a winner. Winning codes have been randomly placed. If you are a winner, you will be required to provide your name, email address and postal address in order for us to send you your prize. Users will be required to "Like" the Dairylea Facebook page in order to use the facebook application.
Please note: Internet access is required. Each code may only be entered once, please type your code carefully. Only one entry per household per day. Any further entries will not be valid. No Purchase Necessary route for Northern Ireland residents only: write to: Dairylea, PO Box 101, Leigh, Lancs, WN7 1WQ with your postal address including postcode in order to prove NI residency. You will also be asked to provide your email address. Holiday Prize: All valid NPN entrants will have an equal and random chance of winning a prize via an independently supervised process, overseen by PromoVeritas, which guarantees an equal probability that an NPN entrant will win a holiday prize when compared to the purchase route. Only winners will be notified. Mooing Fridge Cow: All valid entrants will also be sent a unique code by email that will need to be entered online as per clause 5b. Only one entry per household per day. Any further entries will not be valid. Only the person who applied for the NPN code can redeem it, and should you be a winner, you will be required to prove your identity matches that of the application in order to validate your claim. Only one entry per stamped envelope per day. No bulk entries. Entries from organised groups will be not be accepted.
The Promoter accepts no responsibility for late, incomplete, incorrectly submitted, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.

THE PRIZES
There are 10 holiday prizes available to be won containing a moo gadget. There are 10 winning packs randomly distributed across all postcode regions in the UK/counties in Republic of Ireland. If you find one you will be entitled to a holiday worth up to £10,000 including £1,000 spending money ("Holiday Prize") to be organised by travel organiser, Black Tomato Limited ("Black Tomato"). Subject to availability on the a winner's preferred departure date, winners will be able to select a holiday from the below:

The above selection are suggestions made by the Promoter, should the winner want to travel to another destination it will be subject to the Promoter's approval, which will take into account viability, budget, suitability and the conditions below.
Prize Conditions:
Holiday locations and dates are subject to availability. Travel will be subject to flight and hotel availability at the date of booking the trip. The Promoter accepts no responsibility in relation to the Holiday Prize winners' conduct or their guest's conduct once the prize has been claimed by the winner. All holiday prizes redeemed by the winners are subject to the booking conditions of Black Tomato, the organiser of the holiday. See https://www.blacktomato.com for a copy of the booking conditions.
At least one person travelling must be over the age of 18.
The holidays listed above are based on two adults and two children under the age of 12, excluding the UK Castle which is for up to 6 people (no age limit). Other variations can be catered for subject to the maximum value of £10,000 per prize including £1,000 spending money.
Holidays must be redeemed and return travel completed by 31st August 2014.
All travel must be booked at least 6 weeks prior to the winners' preferred departure with Black Tomato ("Travel Agency").
Extensions to the validity of the prize will not be allowed unless first authorised by the Promoter.
All air travel is subject to the airlines standard terms and conditions. Once booked, flights cannot be altered or amended. Any changes are subject to the Promoter's and Black Tomato's discretion and Black Tomato's booking conditions.
The prize value will also include total spending money of £1,000, or the equivalent value in the currency of the country you are travelling to. This is not per person.
Flights cannot be used in conjunction with any airline loyalty programme, any other discount, discount coupon(s) or voucher(s), promotion(s) or special offers.
For the avoidance of doubt, the prize does not include travel to and from the home to the airport, gratuities, meals, any type of insurance or other travel expenses unless otherwise stated, or any other costs of a personal nature not stated for the winner and guest(s).
Passports and all relevant Visas are the responsibility and cost of the prize winner (as a general rule, passports should have a minimum 6 months validity beyond return date). Neither Promoter nor Black Tomato can be held responsible if the prize winner or any of the travelling party fails to obtain the required travel documentation.
There is no cash alternative or refund for unused portions of the Holiday Prize. If the Holiday Prize value falls under the allotted maximum of £10,000, the difference in value cannot be redeemed for any other item or holiday.
The prizewinner and their party (where applicable) are responsible for and must comply with any health advice / regulations / inoculations required by any destination country. Any associated costs for this are the responsibility of the prizewinner and their party (where applicable).
The maximum value of the Holiday Prize to be arranged with the winners will be £10,000, but it should be noted that this is to include £1,000 total spending money and fees charged by the Travel Agency for the co-ordination and booking of all holiday arrangements. The prizewinner does not have the right to source the same holiday at a cheaper cost from another source and claim the difference in monies saved as a form of income.
Black Tomato's booking conditions will apply in respect of a hotel / tour / transport or any other part of the holiday prize being withdrawn or amended after booking.
Any cancellations or amendments made by the prizewinner after the booking is confirmed may be subject to cancellation fees or administration charges as per Black Tomato's booking conditions.
Comprehensive travel insurance is not included in the prize and is mandatory for the winner and guest(s). This will be the prizewinner's responsibility and proof of insurance will be required prior to departure.
There is a chance of 20,000 secondary prizes being won via Unique Code Online Entry, consisting of a mooing fridge cow ("Mooing Cow"). The mooing cow can be placed in the fridge and will contain a sensor, which will activate the moo sounds.
Please allow up to 28 days for delivery of your Mooing Cow from date of entry of a winning valid unique code and completed claim, for dunkers and tubs winning claims and 28 days for delivery from receipt of a valid URN to the handling house for portion winning claims.
The winners must, at the Promoter's request, participate in all reasonable promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and images in promotional material.
The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition or accepting or using the prize (including to any guests), except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
The prizes are not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation. In the event for any reason the prize winners do not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winners and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize. If for any reason a prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value.
The winners agree to comply with the reasonable requests of the Promoter and its agents and shall also be responsible to the Promoter for the acts and omissions of their guests. Winners and their guest must act within the framework of acceptable and proper behaviour during the course of the prize trip and comply with all rules and regulations laid down by those providing the elements of the prizes.
If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.
If a "winning" entry is deemed not to comply with these conditions of entry, the entry will be disqualified and the prize not awarded.
The Promoter reserves the right to publish the names and counties of residence of the Primary Prize Winners.
The names of the Holiday Prize winners may be obtained by emailing "Dairylea Winners List" to dairylea@bmbneon.com up to one month after the Closing Date.
These terms and conditions are governed by English Law and shall be subject to the exclusive jurisdiction of the English Courts. For Republic of Ireland residents, these terms and conditions are governed by Irish Law and shall be subject to the exclusive jurisdiction of the Courts of the Republic of Ireland.
The promotion is pursuant to a lottery license granted to Focus Ireland under the Dublin District Court.
The personal information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. The Promoter is bound by the Data Protection Acts (1984 and 1998). If you attempt to compromise the integrity or the legitimate operation of this competition by hacking or by cheating or committing fraud in ANY way, we may seek damages from you to the fullest extent permitted by law. Further, we may ban you from participating in any of our future promotions, so please play fairly.
No correspondence will be entered into regarding either this competition or these Terms and Conditions. In the unlikely event of a dispute, the Promoter's decision shall be final. The Promoter reserves the right to amend, modify, cancel or withdraw this Promotion at any time, but will notify entrants via https://www.dairylea.co.uk.

If any provision or part of these terms is deemed void or otherwise unenforceable in law then that provision or part shall be deemed excluded and the remainder of these Terms shall remain in force.

The Promoter cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Participants in this competition agree that the Promoter will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in this promotion. Nothing in this clause shall limit the Promoter's liability in respect of death or personal injury arising out of its own negligence or arising out of fraud.
