Mis-sold PPI Pre-2005

Is it correct the likes of VW can duck out of refunding mis-sold PPI when the agreement commenced pre-2005? This is the response I have received from VW and Financial Ombudsman.

Insurance regulation started in January 2005. Virtually all car dealers were unregulated prior to Jan 2005. So, you would expect a rejection on the basis of it being pre-regulation. Yes if the business wasn't regulated prior to 2005 they don't have to consider your complaint.
By VW I assume you the mean the VW dealer.0
