Losing money on cancelled holidays.

Paul Lewis has just been on Bbc Breakfast about whether it's legal or not for them to keep your money when you have to cancel your holiday. He told the story about a man who had to cancel when his wife became ill and Thompson Holidays kept the full £2000.
He took them to the small claims Court and got all his money back 'cos they couldn't prove they were losing that much. The Court said somethings like Transfers they weren't going to have to pay, therefore couldn't claim. But even the flight and room they didn't neccesary lose out on 'cos these days we have 'lastminute' which re-sells them.
He pointed out that anyone who has had similar trouble may have 6yrs to make a claim.

One Money Box listener was so convinced they were, he challenged Thomson Holidays when it kept the whole cost of a cruise after he was forced to cancel because of his wife's illness. He went to court and a judge accepted his arguments in full and ordered Thomson to refund the full £2256 plus court costs. Can others follow his lead?
