HELP! Estate Agents hasn't declared Personal Interest

    They may have influenced much more than we know.

    The very obvious thought here is that there may well have been one (or more) other potential buyers that were interested, but the EA put them off in favour of their friend.

    What is the market like in your area? Are things selling quickly/slowly?

    Did you have other valuations, if so how much did they say?

    You need to do your homework to see if the price you have accepted is reasonable.
  • Have you got any proof in writing (or on tape) that you have (belatedly) been told the full extent of this your EA knowing buyer scenario?

    If not, could you get some at this point in time?

    Visit to EA with this "proof" and telling them you will still sell to their buyer BUT at the price originally agreed and suggesting they might like to emphasise this point strongly to their buyer that you have proof of what they did to you (which you just might share with any overarching body they belong to).

    I would also call their bluff - maybe phone the ea up and ask confirmtion of how long you have remaining on your contract with them (even if you know) to get them worried.

    In my part of the world that's not a substantial figure to lose but as a percentage it's massive.

    We accepted an offer and had one accepted within 24 hours then lost our first buyers 2 months down the line and still managed to buy the original house - starting again does not necessarily mean you will lose your purchase.

    Getting other estate agents to value is a good idea, but be wary that they will value high thinking that they will get your instruction.

  • Have you spoke to your solicitor. I would withhold their fee personally but obviously you have a contract. But hey I'd let them take me to court for it and try and get them as much bad publicity as possible

  • This really is a very bad situation and I sympathise with you. I am a contankerous old git and I probably would not exchange but I don't know how easy it is for you to find another dream house in the area in case you lose yours.

    My biggest concern would be that your house wasn't marketed properly to maximise your sale price.

    Last sale I used an online agent which avoids this kind of jiggery pokery.

    Even if its de-listed, RM keep the adverts tucked away that can be found again!


    Edit: Might be zoopla that keep them... but if you post maybe you can get an opinion from here.... but your call... either "be happy" with what is in progress, or not be happy and risk the dream house...
  • That sounds a very good idea to put the RM link up. It will almost certainly be tucked away in the archives somewhere. Might be the weblink address up on your paper details somewhere possibly???

    At the very least, people can see what EA it is that is acting that way (including the EA concerned probably;)) and that might assist noticeably in "calling their bluff". They'll probably try and sort this situation out pretty fast if they know that this is up...and you could always send them an email linking to this thread to be sure and certain they know...
