JBW - Council Tax

Hi.

I have received a text message this morning saying that my account will shortly be issued to an enforcement afent to visit your home. Contact JBW

My story is that hounslow council said that they owed us £312 for the previously flat that we rented and had moved out from in 25 July 2014. I had filled in the moving out form. Then apparently the estate agents informed them that we moved out in march and that is why they wanted to give us the £312 back.

Hounslow Council asked for me to write a letter to issue a cheque in my name with the other two tenants signatures as I had cancelled my direct debit with them after my final payment. I didn't bother to write back because according to me they didn't owe me any money.

Then they put the said amount into my bank account and I didn't realise this. I hardly check my account and since I was receiving my last paycheck from work, I knew I would have a little extra due to holiday pay so I thought nothing of it. Then I receive a letter saying i owe them money and I was confused. I called them and said it is a mistake and the council was like we put the money in your account and I said no you didn't because your letter said you do not have bank account details. They said they put it in october and I checked and they did. They sent another letter in February for a CCJ.

Then I had written an email to the council as a complaint. I asked for a bill so I can make the payments and they didn't send it to me and now they have passed the debt to JBW.

I called JBW and tried to agree on payment plan but I couldn't afford it. The other two tenants have been unemployed. One just got a job recently. They were meant to send a welfare pack so that we could make the application and they didn't and now I received that horrible text message. What do I do? The said amount is now close to £600. I feel like being a responsible citizen has stabbed me in the back and I never made any mistake.

    You had the money though, why has it got anything to do with the other tenants...

    Contact the council to arrange a repayment of the money that was paid into your account on your admission whether you realised at the time of payment you acknowledge they paid you money, now known was a mistake on their behalf so they can't expect full payment as its their error not yours..

    Hope you can get the Ccj removed

    Unless the council are going through a small claims route as a civil case for owing money to council then they won't have obtained a CCJ (a very unusual way of doing it and much much more costly to the council)

    When it's council tax they're recovering it's a liability order via the magistrates court as the standard route as it gives the council much more power.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Then wait until they return the debt to the creditor. If you can't afford to pay what they want and what you offer is not accepted don't force them to take it. They'll probably take the whole payment in fees and nothing comes off your debt.
