Yesterday I received a letter from County Court Business Centre, in relation to a PCN from 13/11/2011. The letter is asking for a payment of £257.86. At that time the advice online was to ignore these letters if you are brave enough. I ignored it and continued to ignore it. All went quiet until this letter landed on my doorstep yesterday. I have no documentation, no photos in relation to the PCN - should I just pay up?

First things first you need to acknowledge the court papers via the MCOL website. Details for this in the bottom right of your claim form. Don't lose your gateway ID or password.
Follow the acknowledgment of service process (AOS) stating you intend to defend the claim in full.
IMPORTANT: DO NOT post anything in the defence box. Don't even start the defence process yet. Once acknowledged your have 28+5 days from the issue date to submit your defence.
If you want further advice then you need to post some more information:
* Who is the claimant?
* What is the alleged parking contravention?
* What do the particulars of claim (PoC) state?
Don't post anything that might identify you and don't say who was driving. Refer only to 'the keeper' (you) and 'the driver' (unknown)0 -
The regulars will need a little more info, like who is the PPC, who has filed the claim, are they real stamped CC letters, also they can only claim the original charge not those inflated figures.0

Thanks for the quick reply, as advised I will start the acknowledgement process on line, but not the defence. Here's a few more details regarding the claim:
The claimant is Excel Parking / BW legal
The claim form states it is from the County Court Business Centre in Northampton -( are these papers real)?
The Particulars of the claim are:
"The claimants claim is for the sum of £90.00 being monies due from the defendant to the claimant in respect of a parking charge notice (PCN) issued on the 13/11/2011(issue date) at 14:18:58 at E*** V*** *** *** etc.
The PCN relates to under registration SM08 ***. The terms of the PCN allowed the defendant 28 days from the issue date to pay the PCN, but the defendant failed to do so. Despite demand having been made the defendant has failed to settle their outstanding liabllity.
The claim also includes statutory interest pursuant to section 69 of the County Courts act 1984 at a rate of 8% per annum, a daily rate of 0.02 from the 13/11/2011 to the 08/03/2017 being an an amount of £38.86. The claimant also claims £54 contractual costs persuant to PCN terms and condition"
Your advice in how to defend would be much appreciated.0 -
yes the papers are real
and that address in Northampton is the real and centralised government distribution centre for MCOL for england and wales (its not a court)
later on you can ask for it to be transferred to your local court
look for similar cases regarding B W LEGAL and EXCEL (or VCS) to see how to defend this
especially read the lamilad sagas on here and on pepipoo forums , as his was VCS and BW LEGAL (or Excel and B W LEGAL)
the main thing is to read up about a dozen other court cases that are ongoing or recently concluded, to get the idea and get the gist0 -

It will tell you how to defend this claim. Once the AOS is done you have 33 days from the 'issue date' on the court papers to submit your defence. You will use that time to do lots of research reading other threads involving Excel/VCS court cases. You'll read other defences and use them to make your own. Then post back here for review/ advice0
