Mr Lender

Hi All,

im new here and this is my first post, you all seem like a lovely bunch so im hoping you can help me!
My brother recently took out a payday loan with a company called Mr Lender, he had issues repaying the loan and I make a token payment of £60 on his behalf. They have now taken the total loan amount from my card (£307) which now leaves me skint! Obviously this loan was not in my name, so i am not liable for payments.
I have spoken to Mr Lender and its safe to say they do not want to help me and consider the case closed, I ve spoken to my bank and they cancelled the payment but said the company may take the payment again (which they have) and now cannot do anything to help me until 30 days pass, i'd really like to sort this out before then as I have bills etc to pay!
Any advice would be greatly received, ive looked at the OFT website but cant seem to see any thing on there that would help me!

    You gave them authority to take money from your account when you gave them your card details. You may think you were only making the token payment, but once they have your card details they will take as much as they can up to the full amount and charges. They haven't actually done anything wrong, if you read this http://www.mrlender.com/Terms.aspx then I'm sure there will be something in there to make it clear.

    Basically what I'm saying is your brother now owes you the money, as you'll have bob hope of getting it back out of Mr Lender.

    Never make payments to these people on someone else's debt, as once you make one payment, they will take the lot.

    This is now one of the most common complaints on here.

    Sorry to say but it's all perfectly legal but dubious on moral grounds.

    We must see half a dozen posts per week on exactly this issue. You gave them your card details so it become associated with this account.

    The harder you fight it, the worse it will get. If you retrieve this sum, the account will go further into arrears and the total repayable will ramp up considerably. They will then take even more from your account.

    The problem is your Brother, not Mr Lender. Get your Brother to start taking responsibility. It is he who should be reimbursing you, not the PDL company.

    Take heed of the lesson, NEVER allow others to use your card in future, nor should you ever use your card to make payments on someone elses account. If you wish to help anyone, transfer the funds into their account and let them deal with the payments.

    And if your brother owes anything else to them or borrows from them again, your card will still be linked to that account, and therefore you will have money taken again.

    Now is a good time to close that bank account and create a new one.

  • i have just spoken to my bank again and have said its not classed as fraudelent as i willingly gave my details. They said i will have the wait the 30 days!
    I have definatly learnt this lesson the hard way!

    Glad you can see the problem.

    If you do wait the 30 days and manage to retrieve the money, that £307 will turn into £507, guess which account they will dive into to take it? Yup, yours.

    The only way of stopping it is to close your entire bank account and move to another bank.

    The sensible option is to go round your Brothers and get it back from him. He has abused your relationship already and left you to sort out his mess.

    Don't bother with the PDL company, they are off your back now so you will have no further dealings with them (unless they were owed more than £307 but that is all they could take at the time, if so, stand by for another withdrawal the day you get paid).

    Definately get the full details from your brother, how much he borrowed, how much he should have paid back.

    At best, you can hope that, that is it, he owes no more and you need to manage until you get your next income, hopefully with some help from your brother.

    If not, you need to find out exactly what he still owes. If he owes more and you can't afford more to come out, then as Apples2 says, change accounts, otherwise unless he pays it all up, they will be back for more.

    Don't just disppear from the thread and forums though, give us some follow up as people maybe able to offer further advice.

    Hi,

    i have been in a similar position and most ppl on this site told me that it was my own fault and i deserved for this to happen to me. however i had a loan with the money shop and i declared myself bankrupt, but before i did that my husband made a payment to the money shop for me to help me out, they kept his card details and recently took £950 out from his account, i rang the bank and they couldnt help but i when i rang money shop i explained to them that they had taken money from a third party account and its illegal for them to do that, they asked me to fax them the bank statement showing that the account was in my husbands name not mine and a copy of the card showing that the card was in my husbands name and not mine, i have done this and they are refunding the money. I would suggest that you contact mr lender and let them know that this is classed as theft and that you are a third party. The loan is owed by your brother and they have no right to take funds from your account - whether you gave them the details or not - you gave your details and authorised ONE payment only and there is no legal stance that they have which allows them to take money from your account as you are a third party. I got this advice from Citizens Advice Bureau.

    no problem! good luck! hope you ya money back, also i would suggest that you get ya card cancelled and new one issued with a new number once they refund the money, they may ask you for copies of the card to prove its in your name n not your brothers - but you cant trust these companies - i learnt that the hard way!
