maintance payments & tax credit

Hi I will try to keep brief, I live with my partner and have 4 kids who live with me, my partner has 2 kids who live with his ex (partners ex lives with someone both work in good job, live in the family home), he has regular contact and pays £360.00 per month, my kids father disappeared of the planet many years ago so I get no maintance payments.....I cant help feeling things are a bit unfair.......dont get me wrong I agree with my partner paying maintance....what I feel is unfair is that my partners ex receives Tax Credit & the extra £360 per month which is not included within her assessment for Tax Credit.....But I recieve no maintance just the assessed Tax Credit which does not make any allowance within the assessment for my partner paying out the £360 a month maintance.....it just seems we lose both ways, I recieve no maintance and recieve no allowance for paying out for maintance, whilst partners ex doesnt have any maintance payments to make but recieves the extra money on top of her Tax Credit from my partner ....was wondering if anyone knew anyway I could have the fact I recieve no maintance or we pay out for maintance to be taken more into account when assessed for TAX credit....???

    I think that only way you will get your money is for the CSA to force payment , I dont think theres any other way to get it.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • unfortunatley CSA is seen as something akin to a household bill so tax credits treat the fact you pay out CSA the same as you would pay a gas bill.
    in a similar way you could receive CSA money at ANY rate £1-£1m a month and it would not effect your entitlement to tax credits

  • oh well....it looks like i have no option but to put up & shut up....as I have no chance of finding my ex for any CSA as I couldnt even find him when I divorced him....just seems a bit unfair that each persons curcumstances are not taken into account.... oh well looks like I will just have to keep moaning about the unfairness of the system to my partner.....!!!!

    I agree with you tifkitten. I don't think it's fair that maintainance payments aren't taken into account when working out tax credits. It means you can get situation where 2 single parents, same amount of kids, earning same, one can be financially better off than the other cos one ex pays maintainance and other doesn't.

    Do you have his NI number? Is the claim still live? Are you on CSAC or CS2?

    Do a google on NACSA.
