Why isn't he moving into the house then? Surely better then living with friends.

Poor partner, as if she uses the overdraft, he will be jointly liable and could end up paying off the lot, if she has no means to pay.

Would they not be better off by moving back to the property (while keeping it on the market ) that has the mortgage as the partner has moved out and give notice on the property As they would not get there money back on her 6 month advance payment.

She wanted a new place so she went for it. She's been spending the overdraft on kitting the new place out, like there's no tomorrow.
Would've been better off staying put but she didn't want to do that.

He's staying with family. He doesn't want the house because it holds painful memories and can't take on the house because there is no chance he could possibly afford to run it.

That's one of the reasons I am angry with her.
Anyway, there's no chance he could afford it. He has less money than her. She has DLA. He has no job atm because he was her full time carer.

So they need to sell it PBQ.

As regards the mortgage payments then they need to speak to the mortgage provider and explain the situation. If they sell quickly enough the mortgage company will probably not be too concerned as they would get their money back from the sale.

As regards HB then if she is eligible for it then it will be paid to her monthly and if she applied when she took on the tenancy then she will receive it month by month. Since she will have no rent to pay for 6 months (if I have understood you correctly) then she she should be OK financially.

I suggest you get your friend to seek some advice as regards her debts unless she is paying them off when they sell the house.

Has she sorted out who gets what as regards the sale of the house? Has she sorted out council tax on the house and standing orders for gas/electrivty/telephone.

Try to get her to make an appointment with CAB if you believe she and her children are vulnerable.
  • She's all talk and no action regarding selling the house. She's into buying (unnecessary) things for the new rented place, spending the overdraft.
She has no rent to pay for 6 months but she hasn't considered the mortgage, council tax etc. and she's spending so much I don't know what's going to happen once the overdraft has reached the limit.

HB can only be backdated for 1 month. They will want to see good cause as to why she didn't claim sooner. Not knowing she could claim is not a good enough reason.
